That is not true. If you have given the tenant a 3 day notice per Florida statues 83.56, you then can file for eviction with the clerk of the court. If you have not done this before I would advise you to use an attorney (one who knows the landlord tenant law). --205.188.xxx.x

Look for an eviction service, some other lawyers learn the business while you pay 125bux per hour, visit housing court and watch for someo0ne who goes in with a folder of files, moves towards the bench and back quickly, get a card in the hallway and a flat-fee price, normally 250-400 for both unit recovery and damage (money award) hearing that follows after the set-out. --76.241.xxx.xx

That, among many other rumors, is 99% hooey.

Other rumors:

Can't evict on Christmas / Christmas Even.

Can't evict during sub-freezing temps.

Can't evict (fill in the blank).

Sometimes a local magistrate may close out all evictions because of his or her personal preference, but that has nothing to do with the law. You need to find out if this is the case in your area. Ask land lord / tenant attorney in your area what they know about the judge, if he/she does that. If the judge does, be sure to let him and your fellow land lords know that come election time, there will be payback at the ballot box. --208.70.xxx.x

I've been told officially that my Constable refuses to evict during certain holiday periods. This is NOT state or county law, but it is a reality I face. It would not be cost-effective for me to try to force him to do his job.

You can evict tenants with children no matter what their age is. There are legal hoildays that the courts are close , so you would not be able to file an eviction.

S i d [MO]: In Chicago, the judge and city will NOT evict anyone in sub-zero weather. This is why a majority of the landlords try to get an eviction BEFORE the winter.

Also, during holidays, many judges get into the "holiday spirit" and will not grant an eviction during that time. Maybe afterwards, if you're lucky, but not during these festive celebrations. --99.36.xx.xxx
