State Specific Question About: MASSACHUSETTS (MA)

What is the procedure for mailing the Security Deposit Accounting Statement in MA when the tenant did not leave an address? I was going to mail it to the unit, request forwarding service, and send it with delivery confirmation and tracking. I will also check w/the Housing Ct, but can't until later today. In Indiana, you don't have any obligation to return the security deposit until the tenant provides a mailing address. That said, I would still send to the last known address, or rented unit address and if it is returned, keep it, unopened, in their file. --140.182.xxx.xxx

I do the same as Dan and Kyle. It proves I made the best effort that I could. If they come back after 30 days (or whatever the time limit), I would make them sign a receipt stating that they a) failed to give a forwarding address so b) it is their fault that he accounting statement I provided didn't reach them in time according to the law and c) they release me from any future claim of improperly accounting for their security deposit. --208.70.xxx.x

Turns out the housing court said not to send it certified, because if it is not signed for, then it was not received (letter of law). They recommend sending it delivery confirmation, with tracking, fowarding service requested. The good thing about the certified mail, is that if they do sign it, you have your address. I know where the piece of dirt is within a one block radius, I will just have to do a little PI work. This one's going back to court. --76.119.xxx.xxx

Here it is suggested using the green card cert mail, however in a suburban court I only have to send delivery tracking and bring the delivery status to court to prove delivery. Which does not make sense - court wants perfect service or stall. --76.241.xxx.xxx

Kyle - if this helps...

The Indiana Appellate Court (they make the rules) recently announced the Security Deposit Settlement document must be mailed no matter what. It does not say WHERE you have to mail it and they were clear that the tenant IS NOT required to provide a forwarding address.

AND...Indiana's 45 day deadline starts WHEN THE TENANT MOVES OUT - not when they tell you or you find the home vacant!
