State Specific Question About: ILLINOIS (IL)
Ok, we have a 10 motel converted to montly rental. The guy in #5 got drunk or high today, took off in his boxers and socks only. Got into some kind of crash and flew into the parking lot with a smashed front end and left rear tire in shreds, driving on the rim. Yeah, I know it sounds like a scene from COPS on Saturday night TV. So the cops are right behind him. They grab him and start talking to him. Two more squad cars arrive. He makes a run for his front door in his socks and the cops draw guns and tazers. Of course they kicked the door down, cuffed him up and took him and his wrecked car to jail. In the morning I 'll have to board or repair the door. Now, his rent is paid untill the first of May. In Illinois I am supposed to give 30 day notice of cancled lease. Does anyone know of a quicker way to be rid of this guy? --98.223.xxx.xxx |

Well unless he can make bond He's going to be in the can for a while. Go ahead and give him the 30 notice so in case you can't find a quicker way at least that's in the works. In Indiana we can file for emergency possession if the tenant commits or threatens to commit waste to the property. I have never been through this process, so I can't tell you exactly how it works, I think there is an emergency hearing within 3 days. See if Illinois has something similar. It's at times ike these I really miss Radar. He had his motel "compound" on weekly rates. It meant he only have to give a 7 day notice as that was one rental period. Given the problems his clientele usually had with the law, and the desire of his tenanta not to go to a courthouse for any reason because of that, he usually managed to do a creative self-help eviction. Cutting off their a/c and cable were favorites and very efective.
Give him a 30 day notice but as soon as he doesn't pay May rent, issue an eviction notice. Easier to evict for non-payment than anything else. His money is going to go for bail. --174.130.xx.xxx |

I had a friend who would actually take the front door off the hinges to get people out in the old days.
But those days are gone, and some of us know from personal experience the backlash and harm a landlord will reap for himself if he makes any attempt which might resemble a self-help eviction.
The emergency posession sounds like the best course of action and do call a lawyer who has rental experience.
In NJ, the Bar Association will provide phone numbers for lawyers who will call you back within 24 hours to answer questions on the phone for approx. $30 for 30 minutes. You can find the number in the yellow pages. --68.39.xxx.xx |

Is he on month-to-month or lease? Usually, 60 days notice to terminate lease, 30 days for month-to-month termination.
I will just give him his 30 days notice to leave. May get lucky and he leaves......
