State Specific Question About: MASSACHUSETTS (MA)

my tenant is complaining about microwave "not turning anymore". it still heats. would most landlords replace it with a new one that "turns"? (18 months ago, he complained that refrig didnot keep food cold . i replaced refrig, but i am still using it as a spare in my garage. it keeps my beer/ extra food COLD...)

also he is complaining about the carpet. it's 2 years old, was new when he moved in 2 years ago, but his dog ruined it?

You can buy a microwave at Walmart for about $20 (not sure if it turns or not). If it is really broken and I could solve it for under $50, I would do so. It costs a lot more to replace a tenant. --74.8.xx.x

I would replace the microwave. It's my understanding in MA, if you supply an appliance, you are responsible to keep it in working condition. I hope you have a detailed statement of condition on this unit! This way, if the carpet is logged as new, photographed, then you can require that he cover the replacement cost if his dog ruined it. Get in control before this tenant finds a way to - inspect tomorrow for all damages and bill for these repairs to get the house back in the rented condition, it sounds like your tenant will be buying new carpeting so collect now and replace it when they leave - there are options such as no more carpet or no more pets, you know how your market works so choose the weakest poison when you must. --76.241.xxx.xxx

I provide counter top Walmart microwaves as a courtesy to tenants. I don't expect them to last, and I expect them to steal them (though nobody ever has - guess they are too cheap to steal...).

Anyway - I would NOT provide a built in microwave and if a countertop dies it's the tenants problem.

I also recommend they buy a countertop toaster oven and use it both to reduce heat in the summer and because it reduces wear on my ovens.

Bottom line, if you provide the microwave you have to replace it (not worth fixing) if it's a "gift" it's their problem.

I would NOT have replaced the refrigerator. If he has a pet I would NOT replace the carpet - I would tell him you will allow HIM to pay for new carpet if he wants it. --76.90.xx.xx

Great idea on the toaster oven, may have to borrow that idea. A lot cheaper to replace than a full size range and like LL said, would really reduce heat load in summer., --96.31.xxx.xxx

To me, the issue here is that you have a PITA tenant who is controlling the LL-tenant relationship. If his dog ruined the 2 year old carpet, he needs to cough up the $$ to replace it. You need to start pushing back on some of these things. You've already replaced a refrgierator that seems to be working. Time to turn this around. --98.66.xxx.xx

LL-AZ has it right with the temps check with your point-shoot tool, fridge can drift 34-38 - freezer needs 0 or below, twist the door to make it seal tight. --68.76.xxx.xxx

I had tenants who "found" a puppy. It chewed up the new carpet within months. There were 8 inch parts missing... Document the carpet, and make him pay for that and all other things you find NOW. Kicking the can down the road doesn't work. Frequent visits are necessary! And woe to you once they sense anything they want they will get.
