State Specific Question About: MASSACHUSETTS (MA)

Rental tenant been there for 6yrs. Just had a baby. Not lead certified. Pretty sure there is no lead. What are my rights? --50.136.xx.xxx

You have no rights. They are not allowed to live there in MA if you don't have a cert (unless it is a newer building as Irish mentioned). However, you are not allowed to evict them or terminate their tenancy over this issue. Legally, you should put them up in a hotel and delead. Realistically, I usually have a talk with the tenant and explain that they'll have to move to a hotel while I bring the place into compliance and have it inspected. I explained that it could take a long time. I also am frank that it will be very expensive to do this and I'll have to increase their rent afterwards. With that, they are usually very cooperative in finding a new place. But you must tread carefully. --74.8.xx.x

Are you SERIOUS? This sort of control over who can live in private property is allowed in America? Remind me to never buy property in MA or several other states.

Some of these laws are just getting beyond ridiculous. This country was FORMED because a government located several thousand miles away was imposing draconian regulations and taxes.

Dan has it 100% right. If they do choose to leave, get your lead certificate while it is empty so that you never end up in this situation again. I know it's extemely unfair, but I try to look at the bright side. If you ever sell, that lead certificate is gold to the buyer. MA will give you a tax credit of $1500.00 for every unit you bring into compliance. I know that isn't nearly enough, but you may find that you don't have much lead there. You can get interest free/low interst loans from state to delead. Renovations may bring in higher rent. --71.89.x.xx
