A Chinese friend of mine is having her grandparents from China come and stay on a 3-week vacation but her landlord told her she could not have them stay there. This sounds illegal to me, as long as she let the landlord know they are coming and the time is less than a month, then they'll be gone. Can he legally do this?? I'm very concerned about this situation because they cannot afford to stay in a hotel and are coming soon.

Three weeks is a long time. They

need to pay the LL rent if they are

going to be there that long.

A lot of wear and tear on the house/apt

can occur in that lenght of time with

Check the lease and state/local laws. It is legal to limit occupants of the unit and for the lease to define occupants. My lease states no visitors for more than 10 consecutive days, or 12 total days in a 12 month period without written approval. --71.194.xxx.xxx

If they signed an agreement limiting guests they are bound by that agreement. Why someone would try to not allow a family visiting is beyond me though. I guess they may have their reason such as they are . Practically speaking if my family was coming to visit me I would have never brought it up to begin with . I would now ignore the the prohibition and maybe have the local news channel or a prominent Chinese American social organization with me when I met the family at the Airport and make it public that My LL was being so inhospitable. Fair's fair it's all a game and some people just have an Eric Cartman complex. What's the worst that can happen if Grandma and Grandpa Visit ??? Legal, Illegal who gives a rats A-ss? Our lease limits guests, but the intent is not to stop G'ma and G'pa from visiting. I don't want various friends and/or relatives moving in or spending several nights a week there. I tell our tenants--if G'ma is coming to visit--let me know it's G'ma and how long she'll be there.

Our lease agreement states under Guest Clause -- guests have three days and then out. If not out then Tenant will be charged $100 per person until removed.

If you let them stay for the full three weeks. Have them sign a guest receipt for xxx amount with stating when they would be out.

Perhaps, in the past, the LL experienced guests moving in with a tenant and then not moving out.

I don't think the landlord is being unreasonable. I have a guest clause in my leases - no more than 14 days in any 6 month period without written authorization. I'm not trying to be harsh or keep family from visiting - just controlling who lives in my house when they are not listed on the lease. --157.166.xxx.xxx

I do the same as JoeM - but I include the "unless approved in writing by the owners". There has been one occasion where this saved us a potential ton of trouble when our tenants with four kids wanted to bring a troubled teenage girl from out of state in to stay with them for the summer while her mother "simmered down" - and so she could provide child care while the tenants worked.

As for the Chinese parents, I would want some kind of proof that they were only visiting, and not immigrating. --71.175.xxx.xx

Maybe I haven't been a LL as long as many of you (8 yrs) and haven't experienced some of the problems that guide your decisions but I have to admit I am more than a little shocked at some of these responses.

I can't imagine ever telling any of my tenants that there are restrictions on their family visits. I do understand your concerns if the family members become permanent residents but 3 weeks?! And coming from China? Seriously?

Maybe I'm too laid back but to me if they pay on time, take care of the property and are respectful of the neighbors what more can I ask. I want them to feel as though this is their home and that means little to no interference from the LL.

I have rental properties about four hour drive from Mexico. Trust me you need guidelines on the length of stay at your residences.

If not you could very well have fifteen ppl staying at your rental properties. All trying to live in a very small one or two bedroom home.

Been there before and will not have that happen again.

Ppl come from other areas and just never leave again. Use your house as a Human trafficking residence. Believe me you need to have strong language to keep things in order. --108.178.xxx.xxx
