State Specific Question About: OHIO (OH)
Going to court to attempt to get escrowed rent released. This has drug into the 3rd month. Tenant is mentally unstable and has refused entry to make requested repair of a TOWEL BAR. All other claims are refutable. Our lawyer has only done evictions, so we are planning to go without one. What should we know? --24.209.xxx.xx |

Get a better lawyer, escrow is a side effect of eviction, spelled in OH law but local may have over-ride, I found a new court last year once you file they can not escrow - only way is out. And any property can be stored but not released until you and storage are paid, my tennis shoe heels were clicking! --76.241.xxx.xxx |

After another read of this am I reading that you are not evicting this tenant for non compliance with housing maintenance request, this is obstructing justice and should be an easy evict regardless of mental stability, use a civil assist for servicing the unit and charge the tenant social work staff to help in this matter, if you do not evict you will not get the escrowed rent as the repairs are not completed and the tenant will win for the same reason - incomplete repairs. Stay in charge, and get social workers to hold the tenant so you can repair or let them go, out to family who can make repairs. --76.241.xxx.xxx |

The tenant has put rent in escrow with clerk on time for both Feb & Mar. We will go in front of judge bc I filed counter suit that we never agreed to make the repairs on her "honey do" list and they are not code or health violations. She accepted the unit in the "good" but not perfect condition it was in. This is not an eviction case...I am well versed in eviction court but this is different. If you do not make the repairs you can not recover the rent, use a social worker to restrain the tenant while you fix the towel bar, take photo and file motion for release of escrow, you should be able to do this pro-se. --76.241.xxx.xxx |
