State Specific Question About: OHIO (OH)

Eviction hearing yesterday- they did not show, we won possession back. It is a 4br house with 5 children living with the tenants. Served 3 day notice day after house was raided- they are traffickers (I did do a criminal check online- obviously a BAD one).

Texted her (she won't answer phone) that bailiff will soon be posting notice to vacate in 4 days, no response. Hoping they leave and take their crap, but planning for the worst. We have to bring a minimum of 4 people for setout. How does this work? If they have to be told to leave, where will they be? standing there while we put belongings to the curb? harrassing us? I was actually involved in a setout a friend had to do for a single girl in a 1 bedroom apt- it was hellish- I am having a hard time envisioning this for a big house. How many people to bring? He's been arrsted twice in last 2 months, with guns, and is out on bail- shouldn't the cops automatically be there for this? Was told they'll be on standby. VERY nervous about this, any advice would be appreciated! --72.241.xx.xxx

Your system is different than mine but with so many posts about setouts, is there a way to observe a setout? We talk about observing court. This seems important too.

Ask the lawman and tag along from a safe distance?

Might be different in your area, but here the bailiff will come to the house @ the set time, see if the tennies are still in the house. If so, they'll be ordered off your property while you and your workers remove their junk and set it on the curb. Once on the curb, it's fair game for anyone to take.

Why not call the bailiff's office and ask them what is going to happen?

Also, if you fear violence, maybe alert your local cops to ask them to accompany you to the house...this might be one time when you leave it to the unknown workers to get the junk out to the curb...let the tennies gripe about you, but they won't be able to harm you.

In Hamilton County, the Bailiff and you meet at the property at the time of the set-out. They will knock on the door. If they answer, the Bailiff will tell them to leave the property and you move their stuff to the curb. If they don't answer you key in and the same thing. The Bailiff stays until you have moved all of the tenants belonging out. If there is interference by the tenants and the bailiff doesn't believe they can handle it they will call the cops. The tenant is considered a trespasser if they go onto the property again. Over 95% leave before the set out. There might be some left over junk in the property. Keep us updated. --74.83.xxx.xxx

Hire plenty of help.Day labor is great for this work.The faster the better.Go by grocery store and tell them to save banana boxes(any boxes) for you. Heartfelt sympathy for the children. I have move them to the next house.

Thanks for all the feedback! I have talked to a woman who has cleaning/estate sale business, and she does setouts- not sure what she charges yet, but it's a flat fee, not hourly- it might be better to do this than try ourselves with friends- she said it's the same rate whether apt or housefull. I guess my thought process is to plan for the worst case scenario- tenant knows we are inexperienced, and I kind of wonder if she thinks we won't actually follow through, and plead for more time because she has 5 kids (whatever, don't care anymore- and it's a shame if Children's Services has done nothing yet- he has a charge of child endangerment as well as all the drug posession charges). I appreciate the support- I have been on other LL forums and all I got was a shame-on-you attitude for getting crummy tenants to begin with --72.241.xx.xxx

Another related question- what if they do leave before date to be out but leave stuff? I have read all belongings left behind have to be stored for 45 days for tenant to claim- is this different with an eviction? --72.241.xx.xxx

In my area, the bailiff goes in the house. If he thinks they've left only junk, he'll say they've vacated and you don't even need to set the stuff on the curb-straight into the trash can, if you so desire.

Toledo OH.....rented our home of 15 years when we couldn't sell it in time- thought we were trying a creative approach with 2yr rent-to-own......bad idea- tenants there only 4 mos and raided by the narcotics division (in a way it worked out- no question they would be evicted, and our old neighbors will be happy with us again once they're out before the spring/summer) --72.241.xx.xxx

In Cleveland we use a moving company approved by the court. $100 set fee in the city, more in the suburbs. I get the writ of restitution immidiatley so I can get bailiffs scheduled for the move out right away.

If the arrest report said trafficing, that qualifies you for an emergency eviction--out in three days. I think you have to apply for that at the time you file since it affects how soon your case is heard. --174.130.xx.xxx

If you can not get the 3day instant eviction and you go the long way of eviction my experience has been 7 days with no kids and 10 with even in the below zero of winter. Some suburbs require everything to storage and tenant has to pay off you and storage to get stuff back - if you go this way get the good stuff in the first load so it is worth payoff, load junk as junk on the lawn.

10 days to eviction? I'm lucky if I get 2 weeks to hearing, then they get 5 days to move-out. Also, no evictions between Thanksgiving and New Years. --69.89.xxx.xxx
