Thank you Moshe. I was told at first I was to send the tenant a certified letter with a 30-day notice; but I thought it was the 5-day notice. I needed some clarification.

True, and some of us have a hard time seeing the same questions posted here every coupla days.
I think we can agree that many of us are in assist mode - myself included, but when the same question comes up on Monday and again on Wednesday it gets ponderous.
Many questions can be answered by a quick search here. And I doubt I am the only one who rolls his eyes when a landlord asks what to do when someone doesn't pay rent.

Pat, you will find by searching and reading here some answers that may be specific to your region - but in spite of state laws that guide our business they mostly are general in nature, for example the county I live in has different court rules and 3 different type sizes that if not followed a tenant lawyer will toss out your case as it was served improperly. So the best thing is to know your local law for that address/court, many have rules online but if you are not experienced it may be best to visit the court and look for a atty who walks to the judge with the correct answers exiting quickly - try to talk to this person in the hallway and get a flat-fee service rate, housing court is not same as estate planning or traffic tickets, there should be eviction services in your area, here we pay 350-400 flat fee and give 3 copies of the paperwork to initiate the court action, always a good idea to have copy of 3 timely payments so the judge does not consider your ontime rent as unfair. Read here often and learn like many of us did how to get the basics in gear and suddenly you will find yourself saving time and money. Come back and tell us how it goes. --76.241.xxx.xxx |

Don't send it certified, but you can get a receipt of mailing at your post office. Google Va legal aid. Click onto eviction info. It is geared to the tenant, but it tells you in easy to understand terms, EXACTLY what you have to do. My bad girl actually sent me a copy of the booklet back in 2004 when I found out a LOT of stuff I needed to know.
