The SC Landlord/tenant laws do not specify late fees... I suggest you read them for yourself. They are posted under the blue link in the upper left of this page.
You set whatever late fee you want. If it goes to court, the JUDGE decides if it was fair or not.
I've never had mine challenged in court, so I guess most of my tenants think they are fair.
I give a $25 discount for paying before the 1st, and start my DAILY late fee on the 6th, the earliest allowed by SC law. I charge $5/day for my cheap properties, $10/day for my nicer ones. So a max of $125 or $250, respectively. --141.129.x.xx |

Hope I did not sound harsh, that was not my intention.
Additionally, SC has a paragraph included in their laws you should have in every lease. It covers the 5 day notice. If it's in your lease, you can file for eviction on the 6th. I do. If it's not, you have to post the 5 day first. --141.129.x.xx |
