State Specific Question About: MASSACHUSETTS (MA)
OK guys, I am a landlord of residential property, but my question is about my commercial lease. Two year committment, and the day it began, the zoning changed from commercial to village residential, which meant that I couldn't place a sign for my business. I had asked about zoning and signage before the inception date, but was told it was commercial.
Isn't this deceptive practices, and if so, does anyone know how to find cases that will back me up? Hope you all can assist me. I know I would never do that to someone. --24.177.xx.xxx |

I would advixe read your lease again. Your lease should cover the sign and other issues. If it is not zoned for you to open a business, the lease should be voidable. If not, talk to a lawyer.
I would talk to the owner and trying to back out of the deal saying that you can not open a buseinss there due to the zoning changes. It is called constructive eviction, or something like that if the owner can not fix the items for the property. --198.51.xxx.xxx |

Before I purhcased a commercial property, I received in writing from the various City Departments, regulations on Business signs. My first new tenant was ordered to remove his sign. The City had changed their mind. In order for my tenants to have allowable signs, I would have to spend $100,000 and remodel the front of my building. I had a choice, file a law suit with not guarantee of wining or just spend the 100K and get it over with..... --173.58.xxx.xxx |
