One of my tenants accidentally got polyurethane on the porch (5'x5' area of 50' porch). It looks really bad and the existing coat of paint on the porch is fine. These tenants are moving into another unit in the same house at the end of their lease so they are good tenants. My question is how would you handle the damage they have done? How would you transfer the security deposit to the new unit? Thanks! --173.70.xxx.xx

Bill them for the repairs. You need to close-out the first lease. If they haven't paid for the repairs by the time the first lease is up then deduct from the security deposit and send them an accounting as required. Start the new lease by requiring the full deposit. If you wish, you can apply the remainder of their deposit to the new lease or make them pay the full deposit up front and then refund remaining deposit from the first lease within the state required time (also send them an accounting if you deduct).

You also need to judge your market and desire to keep the tenants. I can't imagine a little stripper and a couple hours of painting being too expensive if that is the only dammage. Will you loose the tenant over it? Can you replace them easily with as good or better tenant? Questions you have to ask yourself, you may wish to just write it off. --64.218.xxx.xx

Too bad but it's a costly error.

I had to bill a guy $850 because he spilled a $1 can of paint (mistints from Lowes) on the living room carpet.

When the guy backed into my Porsche, the dent was not very big, but the repair bill was!

PS: did he make any effort to clean it off while still wet? No effort, no sympathy. Did he leave it for you hoping you will let him slide?

Any way to strip it or paint over it? Eh could do that and avoid your $35 per hour fee.

The security does not transfer - have them add 500bux to cover this kind of stuff, write the lease with the 500 applied to rent and the full security amount applied, this way you do not lose your money if they lose theirs. --99.128.xx.xxx

I would talk with them and get a feel for what they are willing to do. A mistake is just that, but someone has to pay for it. If they are good tenants and you want to keep them, then work with them on it. Halves on the damage fix, higher rent, pay off over time-what ever works.

If they are entitled and just want, then bill them for the damage and let the cards fall as they will. I would hire the work done if you choose this way. I would keep SD separate from unit to unit. no matter what you choose. --69.59.xxx.xxx
