State Specific Question About: PENNSYLVANIA (PA)
Hello, I have a home that I rent for 2 people. Lease is written up for both tenants. It's a boyfriend-Girlfriend relationship. The male tenant called me the other day asking to get out of the lease, perhaps due to a breakup in the relationship. I informed the tenant that he should fulfil the term of the lease. Are both tenants obligated by law to obligate the term and length of the lease. The is a 1-year lease. The female tenant has not contacted me. --67.186.x.xxx |

What does your lease say? "Lease is written up for both tenants" is kind of vague. If you don't have a "jointly and severally liable" clause (i.e. both parties are FULLY, 100% responsible for the FULL rent), you may have trouble.
How much time left? If only a month or two, consider allowing them an early out and find some new renters. If a long time, go for an ELT (early lease termination fee--1 or 2 month's rent).
Ensure next time your lease clearly states that just because boy-toy don't love his sweetie bumpkins anymore, doesn't mean he can skip out on rent. Otherwise, known as a "jointly and severally liable" clause.

No one is obligated to fulfill the term and length of the lease. Anyone in the US is free to go and to live where he pleases.
In the event that a tenant with a fixed term lease decides to leave, then he may be liable for monetary damage which you suffer as a result of his terminating the tenancy.

Most standard lease has an early termination clause. My lease says one month rent if they stayed for more than 6 months. 2 months rent if stayed less than 6 months.
Check your lease. You may want to call up the girl friend to see if she wants to out or taking on the lease on her own. Of course, she will have to qualify with her own income. --198.51.xxx.xxx |

Jeff, a contract is a piece of paper. Its not an obligation. It may promise an obligation, but it usually doesn't state that tenant shall remain in the property.
If tenant choose to go elsewhere, if he owes money as a result, then that is the total extent to which the contract can be enforced.

You can be right and legal all day long but affairs of the heart don't follow contracts. One of them has already moved out, so get what money you can - turn this lemon into lemonade before they both disappear.
If it's NOT in your lease (I have NEVER seen it in another lease), tell them it is your Standard Policy for such situations. --50.129.xxx.xxx |
