State Specific Question About: CONNECTICUT (CT)
Got tenant that doesnt want to leave. I let him rent my second home because I could no longer afford 2 mortgages. Now im stuck paying the mortgage anyway and have to take additional time and cost to evict this guy who refuses to pay or leave.
Ive been going to the courthouse,takin days off from work, and it feels like the courts back the tenant. Im told that I basically have 0 rights from local police.

There is a link above (below the picture of the Arch in St. Louis) to Connecticut eviction procedure.
If he is not paying, he can be removed.
Go to eviction court, see who are the lawyers doing a good job and talk to one.

get an eviction lawyer, the courts are super picky here, I do my own evict if simple if pros then I get an attorney,
advice from court house employees will not help you get your unit back. peroid. they give vague stuff that judge rules invalid, it takes 4 -6 wks to get someone out in ct , unless you are real lucky --99.20.xx.xxx |

The Police are correct you basically have Zero rights and any rights you do have are going to cost you a bundle to enforce. You can expect all the "justice" you are prepared to pay for.Read up carefully on your states LL/Tenant law . You might try bribing your tenant to leave , known as "cash for Keys" . after this is over find a good realtor ( go to Daveramsey.com and contact one of his ELP's and sell one of these houses. What does your lease say?
I was in JP court just the other week for the first time. I was really impressed at how logical and straightforward the whole process was. It took about five or ten minutes; my attorney had copies of the judgment in our favor already drawn up; we got the judge's signature; and that was that.
I'd definitely recommend an attorney to walk you through the process, at least the first time. Sometimes you need to ask for help-- if you have a plumbing problem you can't solve on your own, you call the plumber. If you have a legal problem you can't make headway on yourself, you call your attorney. :o) --209.33.x.xxx |

Cops told me to crumble up the lease and throw it in the garbage. It means absolutely nothing. lease only have value if both parties honor itand care. Have you been through the CT court system? Its joy.
Now this guy can further damage my home and have no worrys about paying me back finacially because hes broke and doesnt work. Only thing I can do is if the cops think its vandalism or malicously damaged property then they can charge him. Thats awesome,but who fixes the drains when cement has been poured down them?
Being a landlord is great!

Jeff is correct in one way: we want to avoid rewarding bad behavior. HOWEVER, in this case the most important thing is not fixing or rewarding bad behavior. The most important thing is getting the deadbeat out and getting control of your unit back as quickly as possible so you can clean and re-rent to a paying tenant.
Even if you go thru the long, expensive, excruciating process of eviction and toss this guy ion the curb, it will not change his behavior. He is a deadbeat and has chosen to be that way. This is probably what he will be his whole life. We are not morality / behavior police; we are businessmen. Get him out in whatever manner is the QUICKEST. If cash for keys, I'd also suggest having him sign a document officially turning over possession to you, and both of you agreeing that the lease has been terminated early. Sounds like you might need this as additional protection in CT, to avoid later complaints of illegally taking back possession. --208.70.xxx.x |
