State Specific Question About: NEW JERSEY (NJ)

How do I recover money when they know what to do and do the investigator or supervisors just aren't taking care of it? Checks for rental assistance were lost in November. One was cashed by another of their accounts without endorsement. Before Christmas investigator said they cut one back to the agency, and it was going to be cut to me again by so and so date. Then despite all my calls again I did not hear back for 5 weeks. Then he says it will be done on Monday 2:15, and he'll call at 2:30- three weeks ago. Nothing. Another supervisor calls his, she tells him to get on it in the morning. That was 2 weeks ago. Still no call or action. So I am not able to go there in person due to work, etc. What is my recourse? I am so close to the line its caused much suffering on my part. Can I sue? Do I write to higher authority? The whole thing is ridiculous, or 'fishy.' --71.183.xxx.xxx

Start the eviction process and tell the tenant why, they will get on the agency harder than you can and they will get it resolved --67.252.xx.xx

You cannot evict the tenant for money owed by the government.

Use certified mail for money matters if you are unable to handle it better, how does another account obtain your check? Demand a re-issue payment in December, and up-to-date payments. The green card will be needed to evict, you also want a copy of the check that went the wrong way as proof, why have you waited 3 months? --76.241.xxx.x

What I learned from trying to deal with the Dept. of Education one time regarding a boat load of interest that I did not own on a student loan is that it is a waste of time to deal with the people that are causing the problem. After beating my head against a wall for a year trying to get the problem straightened out I finally contacted my Congressional representative. Within days the problem was resolved and the DOE was calling ME to make sure I was satisfied and could I please call the reps office and tell them it was resolved.

The take home is to find out who they REALLY are accountable to and then go after them. I don't know anything about rent assistance checks or who it ultimately falls under, but if there's an elected official I would get with them. Good luck. --12.129.xxx.x

I see this as the agency not caring accept for one supervisor who is not in investigations. Calls don't get attension and the tenant is up on her rent. The other check was cashed at a Cap 1 bank in Long Island with no endorsement. They had the copy of the back of the check and i asked for that. I even know someone in the area there at that bank who will handle that end but the state people are not cooperating! --107.51.xxx.xxx

I am not sure I understand all of your post. However, back in the days when I had a number of Section 8 tenants once my check was sent to someone else. That created a problem for me. Then the Housing Authority said they could not do anything until the other person returned it. After many days and my being very assertive, they finally reissued a check for me and stopped payment on the one that was never returned to them. --70.246.xxx.xxx

I'm with Rangor. Call your Congressman, that's why you elected him. He has a staff that will do an inquiry at the Department level post, you will know the day they call the department because you will be getting a call to try and make it right. Lifer federal employees are motivated by keeping a low profile with Congress, they really don't like being on speed dial. --64.218.xxx.xx

Sounds like somebody in the office took the checks, endorsed them and cashed them. That's why you are getting the runaround. Start evicting the tenant and let the judge get on it. --69.141.xxx.xxx
