Is this a basement of a single family home? Is it a basement that is part of a duplex where each side has a separate basement? Is it a common basement for the building? This makes a diference. If the first two, thenm she is entitled to use the basement for storage unless otherwise specified in the lease or rental agreement. Manny, This is just testing behavior from a tenant to see what you are made of. This tenant does nothave a lease. Thus she is month to month.

My suggestion is to attend your local LL association meeting.and get useful on the ground info from them.

Barring a true fire hazard from the clutter you will need to do new leases and enforce new rules with 30 days notice.Do not forget to have new tennants verify how much security they paid, get new credit app and ID copies. Make sure you have pics and document hazard. I suggest you build cages for each tenant. --99.20.xx.xxx

I have several tenants that should live in cages!

If you want to re-organize how things go at your place, understand she will be "upset" and retaliate. In her mind you are taking away her domain and her freedom.

Wanna be right or rich? Keep the money flowing. Vacanies can cost us thousand$$$ in cleaning, rehab, lost rent, and advertising. When she leaves, write a better lease and define the space.

Reid is on the right track.

A good rental agreement should specify exactly what the rental premises are. If the basement is included in the premises, then the tenant is entitled to quietly enjoy the use of the space.

You need to develop a new lease that makes this specification very clear.

It may be too late now, but Manny I think you made the wrong choice. As Brad 20K mentions, do you want to be right or rich?

How much rent is she paying a month? How quickly do you honestly believe you can fill the vacancy in winter months? What will be your costs to advertize, show, make the unit rent-ready? You need to add those costs up and see how much money you are losing. Maybe you already did this and just didn't tell us...

I would have at least tempted her with a $50 a month rent reduction to move all her crap. That'd be enough for a storage shed elsewhere. Then wait until April (prime renting season) to get her out and/or raise the rent back to where it was before WITH a written agreement saying no use of the basement and let her terminate the agreement herself.
