State Specific Question About: MASSACHUSETTS (MA) My tenants are waiting for me to pay for the Sheriff or constable to give them their 48 hour notice so that they can get financial help from the local Government assistance program. I guess that may be the only way for them to move, but It just bugs me that I have to spend 1500(which includes moving them to their destination) so that they can get financial assistance.

That's cheap for MA, but I don't understand what you care that they'll get help later. Basically nobody is going to help them right now, so you need to evict. That $1,500 is the cost of doing business. The fact that they might get help after the eviction wouldn't bother me at all.

The business question at hand is what happens if you don't spend the $1,500 to evict. Will they move on their own? Will they move on their own if you give them $500 cash for being out and returning keys? That are the more relevant issues in my mind. --76.19.xx.xx

this is the last step in the eviction process. I have the judgement and the paperwork the Constable ( who has given me a quote for this process)or Sheriff needs to deliver the 48 hr notice and the movers ready to take out their possessions for storage or to a delivery place that they want there stuff delivered to.

Now if I could negotiate with them I would. But since I have never gone this far in the eviction and they have gone to the Government for assistance and this agency wants to see the 48hour notice to move before they help them with some funds.

It would be good if I could get them to take some cash and move, but they want me to move them too? They have been here for 4 months with out paying rent and don't have any money???? This Constable says I have to use a bonded mover in case the tenants want to sue for damages. --66.30.xxx.xx

OK, wait a minute. The constable should only be charging you maybe $50 to deliver that notice and another $50-$100 to oversee the move out. I'm assuming the other $1,350 is for the movers.

If the tenant gets assistance and can pay you rent, etc after they get the 48 hour notice then proceed with that. If you have some constable that is telling you he needs the full $1,500 to serve that notice then you need a new constable. --76.19.xx.xx

Also, as for "moving them". When it comes to that, it is typically pretty easy to convince them to move on their own for a quick buck rather than letting you bring in the movers.

You simply have to explain to them that the movers are not bringing their stuff to a location of their choosing. Most often, they are taking it all to a warehouse (perhaps 50 miles away) and before the tenant can ever get their stuff back, they will have to pay an enormous amount of fees to the movers. Yes, you pay for the move and like the first month of storage, but even if the tenant gets there before the first month is up, the movers will charge them hundreds to bring the stuff out of storage down to the dock. Then the tenants will have to have trucks or movers of their own to clear it all out of there.

Over the past 15+ years, I've had a handful of tenants that had to be moved out at my expense. None of them ever got any of their stuff back from the moving company. It was auctioned off in each case. --76.19.xx.xx

Dan, The Tenants have told me that they have an apartment waiting but won't be ready until two weeks. But they won't tell me the location or the landlords name, even though the wife said it is in the same town a block away. I don't trust them. But I will try to find a sheriff and work on trying to let them know what could happen with their things in storage.

Once you are at the 48 hour stage & you try to reason with or pressure your tenant to finally do the right thing & leave peacefully it rarely ends well. I find that if I can't convince them before we reach this stage that I am much better off letting a third party handle things.

I don't know about the sheriffs but my former constable (unfortunately he move south) would visit them & put the fear of God into them. I have never had to actually pay for bonded movers & storage. I have paid for a truck rental to assist my tenant's move to their next place.

18 months ago we got down to the wire with one & I was prepared to pay the constable, the movers & the storage facility almost $3,500.00 to get them out. The day before the scheduled move, my constable called & said they would be gone by morning & my bill would be $150.00.

ct is almost the same as MA , the tenants get all kinds of bs from free attorneys, fair housing, The emphasis is on their rights. The advice they get is all about giving the Landlord grief with multiple court visits, extensions. calling city officals etc.

Yes our costs run high here to defend our property. I now have lists and schedules and am all business to the nines

I agree with the folks that move the product to a alternate location so they must pay the fees, I discovered a court close to me that will not allow the release until -all- the fees are paid, so move the stuff to a secured storage barn this way - give them what they want, also many homeless shelters want the writ before they feel the tenant has hit bottom, it is your job to help them hit it with the storage barn they must pay for. You and the storage place will both leave a mark on the credit report but yours will be a month before the storage barn. --76.241.xxx.xxx

Patti, I don't know the finer points of MA law. I'll offer this: NEVER spend money on attys, filing fees, moving expenses with ANY expectation of getting a penny of that back.

Look for inexpensive alternatives taht get the job done, knowing that you'll have to spend SOME to get folks out. This money is spent, never to be recovered.

i HIGHLY suggest you get with Dan , Steve, or someone local who knows the system.

Your tenants know the system better than you.

The two week thing: it's a lie - a typical deadbeat stall tactic that naive LLs accept taught in the Deadbeat 101 classes. --50.129.xxx.xxx

than you Brad, I know they are way ahead of me as regards deceitfulness on how to cheat the LL and the system. I will be going to the Sheriffs office in the morning to give them their 48 notice. I have been talking with a couple of movers on prices, Now I will be trying to find out where to leave their stuff if it comes to that. Nice thing about owning a few storage units along with apts. We just move the stuff into our storage, give them a free month with a signed storage contract then if they don't pay by the 10th we will lock the door, post notice and sell it 30 days later. In AZ storage gives us a lien on the goods whereas residential doesn't. --166.216.xxx.xx
