I suppose that your lease has some clause about maintaining the premises that would shift responsibility to the tenant, however, if this were my house I'd be there fixing it as I try to cultivate a positive relationship with my tenants. --50.48.xx.xxx

If the tenant got a police report then I would replace it otherwise they would be paying for it.Keeping in mind this type of break in is not random,I would bet your tenant knows whoever did it,that is provided the tenant didn't do it because they left the key inside. --67.252.xx.xx

As the Ll I would replace / repair whatever was needed to make sure my building is secure. If there was a police report filed then I would pay for it otherwise I would be billing the tenant. --72.85.xxx.xxx

My rental agreement states that tenant pays for all damage caused by their guests, invited or uninvited. Think that pretty much covers this situation. --76.92.xx.xx

We consider this an emergency and make the repair immediately.

1. I want to see what's going on right away and get pictures.

2. I want to limit OUR liability should someone return to a door that does not operate properly. The CANNOT complain we did not remedy the safety issue in a timely fashion.

Usually the repair is easy - a split jamb or some trim. I want Momma feeling secure.

Usually not worth billing and creating a hassle. I have bigger fish to fry.

I think a police report is important. I find that a tenant will lock themselves out and won't want to pay for a locksmith (we don't go out for a locked out person anymore ,early in my LL career I used to get calls at 2 am for this!) In our rental agreement we tell them that they are responsible for locksmiths but then,.instead of paying for an emergency call.they will break in and a few days later say "Oh a door/lock is broken burglar you know,..please fix it."

They never do a police report on the ones that they break the door,...We do fix it right away,..but bill them if no police report (BTW,..we have never had IMO a REAL break in)

I notice how often that aluminum storm windows screens have those little areas where you can rip the screens to get at the lock latches to raise them if those windows are on the ground floor or off a fire escape.

We also send on a newsletter about having an unlabeled key hidden in your car or with a very trusted friend for such an emergency. --71.123.xxx.xx
