State Specific Question About: MASSACHUSETTS (MA)

Now the tenant has a judgement against them for Rent and possession what are my options for getting them moved out? Do I have to notify them when I am coming into clean or paint the apartment. Are they squatters now. --66.30.xxx.xx

The judgement will have a day the tenant must pay the rent in full then after that day one goes down to sheriffs office to enforce the writ of possession where the sheriff will give a notice to the tenant or puts a notice on the door if the tenant does answer or the tenant is not there that the locks are going to changed. Here it is seven days where often on the six day the tenant has moved out where the rental unit is trashed out. Often the sheriff does not work around christmas but when the first working day in January the eviction process begins no matter how cold it is. Better not to have anything to do with the tenant other repairs if tenants requires repairs. Consider belonging to landlords association where there are listings on this site. Credit checks with two credit bureaus will avoid a lot of problem tenants who have no problem getting evicted every two or three months. Once the sheriff arrives then the rental housing provider has the legal authority to change the locks then the tenant will be asked to leave the rental unit. Sometimes there will be time period where the tenant will have to remove the furniture and belongings. Often on the day before the sheriff arrives the tenant will move out leaving only garbage behind. Problem tenants know the eviction process which is a never ending story which goes on and on every two or three months. Once the furniture and belongings are out of the rental unit then one can clean up along with repairs and painting. Once the tenant is out have the judgement put in the credit bureau files so when the tenant starts looking for another rental unit they may have problems starting another eviction. --74.220.xxx.xxx

File for the writ while you are in the courthouse, the judge would have said how many days - the sheriff already knows when to schedule the set-out, be ready with trash bags and new locks in addition to your local laws regarding furniture/valuables, many times court gives you a sheet, go back and watch some more of these court sessions - free legal advice for the taking. --76.241.xxx.xxx
