High high can your porch be without a rail being required by code?

I deal with this issue on every house I rehab. Code is 30 inches. However, even with a 20 inch high porch I would still put a railing around it,...your insurance agent will raise an eyebrow if you don't.
The actual height of the railing (porch floor to railing top) use to be 36 inches but some newer codes have increased this height to 38 - 42 inches. I just finished building a railing for a front porch and my finished height is 40.5 inches.

I've never yet built one without a rail, but most of them are higher than 30 inches.

In the November issue of Professional deck Builder there is a small article about the estate of an individual who fell from a deck on 07/01/11 in Chicago being awarded $975,000. This was due to a fall over a 32" high railing when code required a 42" high rail.
Most area consider anything lower than 30" high to be a patio not a deck & don't require a rail. Depending upon which code your area has adopted rails net to be at least 36" or in some cases 42" high.
The new IRC code goes into effect 01/01/12. It is the most restrictive & regulated version to date. There are numerous changes to the way decks, porches, railings & their stairs can be built. --151.203.xxx.xx |

I have a house on riverfront property. Everyone here has a party deck built over river water which some people call a boat dock. Railings for party decks over water are not required by code here which I find unusual. --68.62.xxx.xxx |

Aahhh, remembering my party days at a
house built out on the river bank one summer..... ages 18- 29 yr olds....
envisioning all the drunk friends we
would of lost to the river without the
party deck porch railing ~ ha ha. It was
the only thing holding up some of the
drunks ! Railing makes a good place
to set your drink also. ha
