Honest in what way? When you exclude billing practices, your chances increase dramatically. One lawyer flying from L.a. to the East Coast billed 27 hours that day. And my own experience have been shocking and disturbing. One guy with about a dozen clients during that 2 hour session billed each one individually for his time. Others shamelessly charge 10 times the actual time needed to dictate some letter...

Ever wonder how many Attorneys do not get paid when they bill...
Attorneys do bill for prep time and travel time, so when you are fighting over a 10 cent item or a million dollar item the billable time is still the same...
Their is a difference between a billable hour and hourly wage taken from the practice..

I have same lawyer for 15 years now, It does not pay to nickle and dime. For my state it has worked out best to use same person evenif flat rate was better for just one job. --99.20.xx.xxx |

Honest lawyer is an oxymoron. :) They are all crooks, just find one who will be your crook then pay him well, And watch him like a hawk.
I have a wkrs comp case going on. The ins has their lawyers on it And I have a lawyer watching them, and pre-paid legal watching him.
So CtLl - had the same lawyer for 15 years? Maybe you should have got a public defender. ;)

Had the same one for over 40 years, and he has keep me out of a lot of trouble.
Honest LL, kind of oxey also..most are decent, bad ones stand out.

My lender(Servicer) has sent me has send me, without a request from me, Making Home Affordable program because I am 1 month behind on my payments, which I believe they are in error. So I also get a call from a Law firm for people in distress with the homes and they tell me that my lender is one of the Servicers and will not really be able to help me because it is not in their best interest since they don’t own the loan. The Law firm wants
A retainer to start and a monthly payment for about 6 months. I know Nobody works for nothing. I just don’t know who to trust. And in Ma there aren’t any Lawyers who will do this because of the Laws here.

A banker loans money, to give others a chance at their dream, A Lawyer protect the bankers money from those who want to take it, and not pay it back...

I am still unclear about what this lawyer is going to do for you. Are they going to try to force (using the courts) the bank to give you a loan modification? That sounds fishy at best. You don't even sound like you need a modification as you indicate that the behind on payments is an error on their part. If you want a modification then why don't you just refinance? --192.94.xx.xx |

Because I recently came out of a bankruptcy I cannot get refinanced, I have to wait a few years before I can try to refinance. Now the Lawyer recommends that He can do a loan restructuring ?????. Their web site shows that they do the work for real estate and others. I have a hard time trusting anyone I can't look at and sit down and talk with. I'm looking into the error of the payment made and now I see that they have reversed a payment and now I'm looking for the receipt and if I can't find it they may be right. Here's what I would do if the bank thought I missed a payment that I thought I had made:
1. Request a current mortgage statement from the bank for the entire year. This should list all your payments and when they were recieved.
2. Get your bank statements for the same period.
3. Compare the two. That should reveal whether or not payments have been coming out of your account regularly for the mortgage.
4. You say the bank has "reversed" a payment. WHY. That is where you need to start digging. And digging some more.
The bank doesn't get to just start willy nilly reversing payments on a mortgage contracts. It seems like perhaps somebody made a human error on the bank's end? I'd start there if you can document it, and get the manager, branch manager, or regional manager involved.
This right now is a question (looks like to me) of locating the source of the error. Either the bank made an error or you did.
If you did, easy fix, pay the bill and bring the note current, if the bank made an error, get a decision maker. This happens occassionally, but you have to keep hammering to get it figured out sometimes.
Too soon for a lawyer. Tell the lawyer to pound sand. They are scavenging public records looking for people to pay too much for them to fix something you should be able to fix yourself in this case.
This sort of thing happens sometimes. Do tryy to keep good records. That helps. I've had a bank credit a payment to the wrong loan (not mine) before and I've had a bank record an 18K deposit as 1800 before.
Both got fixed, but you do better and get results faster if you have good records.
