State Specific Question About: NEW YORK (NY)

My tenant has not been paying for 1 year because my bank threatened foreclosure. Here are my questions:

1. Can I ask the tenant to pay back the rent? How many months backwards?

2. Can I evict the tenant? How's the procedure and time-frame?

3. Does the unpaid rent affect tenant's credit history? --67.244.x.xx

Until the property is transfered you are entitled to rent, I doubt if any court will award more than 2-3 months time, you should have began eviction on the 2nd of the month when the rent was late, there is no reward for sitting on your hands, just ask the judge about this. mp - YIKES!! Unless you are in some kind of weird rent control area or funky foreclosure rule community, it's time to get busy.

For this amount, I suggest you hire an atty that specializes in rental cases.

After you get a court judgment, the judgment will show on the resident's credit report.

Get busy and don;t spend lots on the atty because chances are very high that you will not see a penny from this tenant. --50.129.xxx.xxx

Do an eviction,you are entitled to the rent during the timeframe you own it.Foreclosures can take 1 1/2 years to complete in NY state.I have seen banks stop the action at the last minute or just never even start a foreclosure action if they decide the house was not worth the effort.I have seen and helped landlords do evictions with this much rent owed and they win a judgement but I have seen the judges tell the landlord they need to learn the business.If you know where they are working you can garnish wages.Where is the property located? --67.252.xx.xx

This is most disturbing! The longer they get away with not paying, the lesser the chance to ever collect. I would evict as this guy is bound to hold on to this dream like situation! He would have a problem if he was to apploy for a mortgage. WFC demanded more than just an assurance from me that a tenant applicant "paid".
