State Specific Question About: OREGON (OR)

Is it a requirement in Oregon to have a fire extinguisher in a rental home? Also does there need to be a working smoke alarm in each bedroom. This is a small house--1008 square feet. There is one new working smoke detector in the hallway.

Penny, I don't know OR law but I'll drop in my 2 cents "for your consideration".

Smoke detectors save lives and a dirt cheap $4 on sale WITH a battery. We've had several rental fires over the years, one resulting in a death. She may not have been able to hear the SD over her window AC and headphones. $4 inside her bedroom MIGHT have saved her life.

New building code requires them INSIDE each bedroom and can share one outside each bedroom within 12 (not sure, maybe 15 feet) of the bedroom door. Also one on each level.

2 of our house fires were in the attic and the occupants did not know their attic was on fire. So for a measly $4 we install a non-required SD in the attic.

If the house is older, these are not required but are so cheap, why not?

Our state now requires the tenant to maintain them - batteries, clean, keep in place...so while you're checking OR law, search out who maintains.

If you have the ability to wire in a 110 smoke with battery back-up you will find they are much louder than the battery only, in my areas the inspectors all like this especially if I can wire the basement together with second floor then they all beep when you test any one, model i-9210b is the one I use with ionization detector to prevent false alarms from bath and kitchen steam. I don't know about OR, but I put extinguishers in all my apts. If nothing else it gives the tenants something heavy to throw at each other. Smoke detectors are a good idea as are CO detectors. --76.170.xxx.xxx

Hi Penny.. and once again.. a good question..

A LL should know or look up these simple questions...

The LL/tenant statutes are on the

Oregon Real Estate Agency website..

Ors Chapter 90 in the 300 numbers.. and Ors 91 to start

For extingushiers..there is no requirement.. but a good idea..

For smoke and CO alarms..

1st by code, newer homes hard wired and one in each bedroom.. Older homes typically one for each floor.. but there are guidelines..

contac your local fire department and city or county

Rules

90.302 Fees allowed for certain landlord expenses; accounting not required.

(1) A landlord may not charge a fee at the beginning of the tenancy for an anticipated landlord expense and may not require the payment of any fee except as provided in this section. A fee must be described in a written rental agreement.

(2) A landlord may charge a tenant a fee for each occurrence of the following:

(c) Removal or tampering with a properly functioning smoke alarm, smoke detector or carbon monoxide alarm, as provided in ORS 90.325 (2).

Also Ors 90 320 has the most..

consider to put extra, my requirements are not onein each bedroom, but I put one in anyway. So I can sleep at night and because i do peroidic inspections on apartments just to check for problems. ( smoke detector battery change, fire inspection( fire marshall sometimes asks for them) furnace filter change, sealing and caulk of windows. ( mine are new but I check them once a year to check for a/c damage) 24 hours some times I tell tenants a week in advance. In my market If I dont check units ever 3 or 4 months it would cost me money --99.20.xx.xxx

We have several fire dectors in each unit, even in 500 sq feet trailers. I really like them if the are wired into the electric. We check and change the batteries during inspections. We also lgged that information. I want to CMA as much as possible in case someone is killed in a fire. I also provide small extinguishers. However they need to replaced alot cause they lose charge. Has anyone got a solution to that? --98.94.xx.xxx

I do very good smoke alarms -- wired in with the 10+ year battery backup. I try to be safety conscious, of course.

That being said, we USED to provide fire extinguishers and STOPPED to it for two reasons:

1. Some kid sprayed one all over the shared hallway in one of the 4-plexes. This was a pain to clean up -- and we had no one to bill for it since no one saw anything, of course. Then we've got to pay to get it recharged.

2. It adds liability. Now it is YOUR responsibility to make sure they work and are properly charged. Also, if they try to use one to save the place and hurt themselves, you never know what lawsuit that might bring.

In my opinion, you are better off to recommend that they get their own fire extinguishers. But I won't be providing them any more (unless required by law, of course).
