State Specific Question About: NORTH CAROLINA (NC)

Tenant recently signed lease through Dec, 2013. She says everything is fine with the unit but she's a full time grad student and now wishes to move back home with family. there is nothing specified in our current lease outlining what to do. What is customary under NC landlord/tenant law in this situation? I'm willing to let her out but feel that we should be compensated well for allowing her to break her lease.

Rather amazing that a contract means absolutely nothing to some tenants.

Your tenant can find a suitable replacement for her (with your approval) and when she does, she can then be let out of the lease.

Early termination fee equal to 1 to 2 months of rent, or whatever time it will take you to re-rent the unit.

I'm not sure about NC law, but I would imagine that a broken lease automatically implies that the future rents are accelerated and immediately due. --168.178.xx.xx

My apt. in that area was a year lease with auto renewal except I didn't read that part of the form.

Ticklish & sticky they allowed my departure saying they'd found a replacement tenant tho I was asked to find my replacement. It's univeristy housing; the U, mgmt opers & small town govts are collusional. --50.52.xxx.xxx

Find an agreeable amount that is win-win and lets both parties move on. No less than 1 month, probably 2 considering it is winter/holiday time.

Send tenant this letter:

"Early Lease Termination Fee $_____. Resident may pay this one time fee and not be held liable for the remaining months of the lease."

Our fee is the rental amount with $75-100 added to it.

People are happy to pay it. I am happy to receive it!

I just realized that even attorneys don't write in lease clauses about ending a lease. I guess they assume everyone stays until the last month.

People leave all the time and this clause protects both parties.

Don't sit and HOPE a judge will grant the remaining months OR that you'll see a penny of it even if the judge grants it.

I'd rather have that fee now and re-rent.

It's a lease. Timeline should be clear, 1 year, 6 months, ect.

I do not have an early termination clause, because it is a lease. Theoretically, they are responsible for every month left on the lease. Early termination clauses would just decrease the duration/amount, but, i could see where you would be more likely to collect.... hmmmm, may have to add another clause!

State rules apply of course. I believe in IL they are only responsible for the amount of time it is vacant, or something like that. --24.245.xx.xxx
