State Specific Question About: OHIO (OH)

****Ohio Landlords-please help!

Landlord may keep the entire SMHA check if the renter is there for more than a day-correct? Unless there is an eviction filed in court. Same with the tenant? (FYI-3 day notice was posted but no eviction occurred.)

Management at SMHA says yes but won't put it in writing-says in is in the tenant/law which I can't find online for some reason. SMHA says they do not have a policy about this.

Attorney stated there should be a prorate and to r/n the check since there is knowledge the renter has another place even though she is not out of mine yet.

****SMHA confirmed that another lease was sign and renter should be out. Also renter was seen starting to move recently. Renter did leave a message will be out sometime this month....However fails to commicate/respond on departure date.

Also I was told that I can't take retainer fee out of security deposit since there was no court action....true?

May a LL deduct from the security deposit if utilities are used after the tenant switches it over but still on premises?

It is in our PHA contract that they pro-rate at the end of the lease. If she really is moving count your blessings. S8 evictions are more complicated than normal. Before you filed you would have to give this month's check back and not get it back until she is out. Evictions for anything other than non-payment are tough to get. --174.130.xxx.xx

Evictions are harder with sec8 unless you have 3 police reports, or anything related to drug action from police, as Gwen pointed out to begin eviction you return a check to HUD office and have the receipt time/date stamped (very important to do this), the magistrate needs to see that stamped receipt to proceed, eventually you get paid from HUD after the tenant has turned over the keys and you do a photo inspection to resolve the security deposit - seldom do the sec8 tenants get money back. --76.241.xxx.xx

MY SMHA will pay for both units. My LEASE says I rent houses by the month, and any hold-over is @ 200% of the monthly rental.

Thanks-I am not evicting-I know she will be out soon. However, before the 3-day was posted by my attorney it was confirmed by SMHA supervisor that she has signed another lease.

Basically-I want to be sure SMHA is not messing w/me saying to keep check since she is on the property. I guess in the worse case-they would ask for a refund if they are not being upfront.

I still don't understand why I can't deduct the lawyer cost w/the security deposit. They said that is only done with court/suing.

Actually-I think I was told about keeping the check after the 3-day notice-not before by SMHA. They just said if an eviction would be filed-it be different.

Anyone know where the info is in the landlord/t law for Oh? I can't locate it and SMHA states the info is in a clause about keeping monies.
