One of my sfh has been vacant since July. I thought I had switched all of the utilities out of the tenant's name into mine once she moved, but learned today because of a past due notice that the water wasn't switched. The tenant moved out of state and owes the water company $142. I'm going to send the ex-tenant a letter explaining the situation, ask for a copy of the bills that show the usage since July, and send the payment to the water company as a payment on the account. If I make the payment directly to the utility, will the utility argue that I owe the remaining balance? I'm on good terms with the tenant, but I know she won't send the money to the utility herself and I don't want to pay her for what is owed to them. Am I legally obligated to send the money to her if she is adamant that it be sent to her? --207.119.xx.xxx

In most places no mater who they bill you as the landlord is still responsible. if this is the case pay the bill and see what you can get out of tenant. I would have taken out of security, but it sounds like you goofed up, hope tenant will pay!! --96.238.xxx.xx

Give the forwarding address to the water co. They'll love you for it and might return the favor some day.

Before you pay anything, make certain your local law makes you liable. In my state, we are only responsible for the sewer bill, NOT the water, trash, gas, elec.

We don't pay until WE get letters from the util co warning about a lien.

The empty house = no usage.

Doubt you would ever see a penny from a resident who has moved out.

Add "cal util" to your Deposit Settlement worksheet - to remind you before you apply or refund their deposit.

Is the water in her name? Did she have the water turn on in her name or did you? Did you tell her you'd switch it? Here, LLs arent responsible for unpaid water bills that are in the tenants name. Tenants open thier own account w/ deposit. The tenant turns it on and if they have it turned off.

I dont understand what money you would send to her, unless you mean you SD. --98.94.xx.xxx

Thanks everyone. In this city, only the sewer and trash stay with the house. I had told the tenant I'd switch the utilities. Everything was switched but the water. I did some updates to the house. So, it was vacant longer than I liked, but was something I planned to do next time it was vacant. I'm a little picky on tenants and went through several look-loos and some apps, but I think I have a good tenant moving in tomorrow. I did a random check on the house and found the past due notice on the door and wanted to make sure the new tenant won't have problems getting service. She won't. But, I like to play above board and would like to pay what I owe. But I hate to pay the tenant for something she doesn't own. The amount will be small but I still need to notify the ex-tenant. But, I wonder if the utility will say I "owned" up to the debt once I make a payment on it. --207.119.xx.xxx
