State Specific Question About: GEORGIA (GA)
I recently sent a tenant a notice to terminate due to excessive repair complaints.( She had a 3 year lease) Since I've sent the notice we talked and we decided I would let her stay. Now that I'm back in North Carolina she tells the realtor that she's not paying until I send her a letter stating she can stay. So I told the realtor that it's no need in letting her stay and that the notice is still effective. She still refuses to pay the rent for her days remaining in the house. What do I do? By "realtor" do you mean property manager? First thing I would do is fire her if she can't take care of this problem.
Don't you have to do a 3 day pay or quit in GA? That would be your first step, then you can file for a court date. --68.70.xxx.xxx |

You are awfully wishy-washy to be a landlord, first you terminate the lease, then you tell her she can stay, then you go home and say she can't.

I am trying to understand. The T has a three year lease. How can you give her a notice to terminate? To the best of my knowledge, unless the Tenant is in breach of the lease, you cannot terminate it.

Don't make a mountain out of a molehill. LL s must make repairs. We have "selective vision" and look past many repairs. If it's broke, fix it.
Our LL goal is to bring in money. Need tenants for that and sometimes we have to be patient and look past the drama.
Be professional and take the high road - The whole thing about holding rent is the T trying re-gain some control after you just snatched it away. You barked and they have to bark back. Just like kids and dogs. You said she could stay so let her stay. If I were this T I'd want something in writing from my LL, too. No biggie. Question is, did she break the lease by breaking a legit written rule? If she did and you want rid of her, then follow thru with eviction. If she didnt break the lease then you may have a problem on your hands. --98.94.xxx.xxx |
