State Specific Question About: TENNESSEE (TN)

Possible Renter wants me to hold house until his lease expires November 1. Said will give me cash to hold. My house is vacant, 75 mil away and utilities have converted to my hame. What is a hold and how to you put this in writing or recommend to do it? --68.53.xx.xxx

Estimated Date of Availability: October 1 – October 15

The applicant agrees to rent housing accommodations located at: __________________ on a month-to-month basis or for a lease period of twelve months beginning on October 1, 2006 and ending September 30, 2007. The applicant also posts a holding deposit of $200.00 for the accommodations. This holding deposit shall be applied toward the tenant’s security deposit of $790.00 when the lease agreement is signed.

In the event the application for residency is not approved or accepted, or if the residence is not ready for occupancy, the deposit will be returned to the applicant at the applicant’s option. If the applicant fails to sign the rental agreement, fails to provide additional funds required for occupancy, or does not take occupancy on the scheduled move-in date, this deposit of $200.00 shall NOT be returned, shall be forfeited by the applicant and shall be retained by us.

Below is a schedule of deposits held and required funds prior to move-in. The balance of $2,170.00 must be paid at the time the lease is signed by money order only.

if his lease ends the end of Oct...he needs to take Oct 15th so he can MOVE, clean his current rental and get his deposit back. Double rent is probably LESS expensive than not cleaning and getting little or no deposit back

Here's the form I use. My holding fee is equal to the total deposit. Also, I won't hold for more that 15 days.

Non Refundable Binder

This will acknowledge receipt of the sum of $400.00 by Two Turtles Property Management from (applicant name) as a holding fee to hold vacant the rental property at _____________________________, until AUGUST 15, 2011.

The property will be rented to Applicant on a month to month basis at a rent of _________ per month, if Applicant signs Landlord's written lease and pays Landlord the first month's rent on or before that date, in which event the holding fee will be applied to the deposit.

Landlord and Applicant agree that if Applicant fails to sign the Agreement and pay the remaining rent and security deposit, Landlord may retain this holding fee to compensate Landlord for lost income and inconvenience.

can't hold 30 days. will hold on a deposit (note not security deposit wording) until the 15th.

need the deposit now and on the 15th half months rent. if you want to sign after the 15th i need a full months rent then will pro rate the days in november.

as an example: rent on the 20th of Nov-- pay full month rent-- then Dec 20th pay 11 days rent to get the tenant to the 31st. Jan 1 start regular monthly payments.

Please note the deposit needs to be at least the rent amount of 50 bucks less.

This formula gets the tenant in with paying 15 days-- 9 out of 10 will pay 15 days rent rather than the full month and then pro rate. --74.184.xxx.xx
