State Specific Question About: WISCONSIN (WI)

Have any of you landlords gone to court in Madison, WI. I have a tenant threatening to sue me for taking minimal deductions from their security deposit.

They claim the stains they left on the carpet are considered normal wear and tear, and that their cleaning was good enough. I have a picture of dirt on the baseboard, but I am unsure how a judge is likely to see things in Madison, as the law seems to favor tenants over landlords.

I'd be grateful for any personal experiences you can share. --66.191.xxx.xxx

I'm not from WI but this is an excerpt from my rental agreement maybe it will be a help to you in the future, " It is agreed that all dirt , holes, tears. burns and stains of any size or amount in the carpets , drapes , walls, fixtures, and any other part of the premises , do not constitute reasonable wear and tear" . Since this is something that the tenant read and agreed to under no duress , it has on more than one occasion kept the situation from going to court and in court has swayed the Magistrate to rule in my behalf. And as an aside, people will threaten you all the time but very very seldom will they actually get off their butts and do anything about it . It's like a poker game and bluffing is a big part of the game. The people who actually sue most often don't say a thing about it till you're served, the rest is bluster. --99.151.xx.xxx

Thanks for the advice, Reid. I will have to think about adding that to my lease.

I think these folks may just sue me out of spite, so I'd love to hear from any others who have been to court in Madison. The property is in Dane County, but not in Madison, so only state and Dane County laws apply. --66.191.xxx.xxx

A threat of a lawsuit is still a long way from an actual lawsuit.

I have only 8 rentals, but I have yet to be taken to court by ANY tenant for ANY reason.

Take out the carpet and have hardwoods refinished... There toe jam comes off easier on wood floors than coppets...

All my tennys tell me they are going to sue me... I take my proof of mailing, original security letter, pics and INVOICES or judge will throw you outta there...
