State Specific Question About: MARYLAND (MD)

Checking on a leaking faucet in my 3 bedroom Section 8 rental to a lady with 5 kids (whom are all on lease)I noticed the sunroom is being used as a bedroom for her sister & 93yr old grandmom who moved in without my notice because their place caught on fire, what should I do? --98.233.xx.xx

Do they pay on time? No problems otherwise? The grandmother gets SSI - that's going to affect the Sect 8 payments and maybe cost you the tenant.

I'm not a Sect 8 LL, so my advice is not worth much, but perhaps there is a way to make a private CASH deal for a bit more $$ to offset your costs and wear and tear. Otherwise you are stuck going through channels and either getting granny on Sect 8 and her own place or evicting right before the slow season.

Granny is 93, she probably isn't going to be there long. (Of course if she dies in your house then you have to disclose that to the next tenants.)

You aren't going to fare well in court or god forbid, the media, tossing a 93 yr old fire victim into the street. If you have to get tangled up with Sect 8 you might mention this fact to them also - about how you are being forced to evict a family at the holidays because of Sect 8.

Fidn out how granny burned down the previous house? Smoker?

In Ohio it is considered fraud to take money over and above what Section 8 has deemed the rent to be. Just something to consider before going that route.

I've only ever had two Sect. 8 tenants, so take my word with a gain of salt. Here, it doesn't seem to be that difficult to add family members on to a Sect. 8 voucher. Maybe you should talk to your tenant and see how long they plan to stay, and have the voucher holder speak with their case worker. But, LL is probably right, it may reduce benefits the sister/grandmother get.

You have to decide how much you are bothered by them being there and if you want to rock the boat or not.

Do NOT try to make a side cash deal. That is fraud. If you don't want them there, then send a letter to the tenant with a copy to Section 8, requesting that the extra persons move.

What you write will depend what your lease says about how long visitors can stay. That does seem like a lot of persons for the house. If instead it is OK with you, then the presence of additional occupants needs to be reported to Section 8 if the time they have been there makes the persons occupants instead of visitors.

There will be an adjustment in the reported income for the household and the tenant share of rent. In addition, the sunroom will need to meet the requirements of Section 8 and of local code to be considered OK as a sleeping room. --70.230.xxx.xxx

Me? I warn them that when Sec8 finds out, they'll be kicked off the program and give them one week to remedy.

If *I* tell Sec8, *I* get no rent. Now I have to evict thru court because they have no money for a new place. Judge is sympathetic to children & grannys and will give them extra time.

They will have no where to go without income, making it harder to remove them.

FYI: the Sec8 lease has a clause to the effect I cannot evict just because Sec8 does not pay their portion of the rent. Their free atty got my eviction stalled over that clause.

Ditto Brad - they can lose thier voucher over having unathorized residents. I would threaten them with this info - but would be hesitant to act because (like Brad said) the remedy os Sec. 8 will stop paying you. --173.66.xx.xxx
