State Specific Question About: MASSACHUSETTS (MA)
After a very long saga of late payments, I was granted eviction during the summer, with a stay of execution for my tenant provided several conditions were met. Most conditions were met, albeit very late, but one of the conditions was that the tenant was to sign a new lease, and was unable to for insufficient funds. Tenant also has no verifiable income, and stated income is well below what is required for this lease. I have motioned for execution. What can I expect in court?

Certainly not an Execution, it is not a hanging offence...
Sound like they do not like you and very tenant friendly...
Let's hope they pay the judges salary in your liberal state..

If they show up in court and fight, they may be given another 2-4 weeks to move out. If they don't move after that, it takes another 2 weeks or so to get them out. If they don't fight it, you might have them out in another 2 weeks or so. --97.252.xxx.xx |

What confuses me is that I was told once execution was granted for a specific date, I can hire the constable to remove the tenant 48 hours after that. Then they come to remove her with a moving truck, all of which I have to pay for. Why has it taken you two weeks past a dated execution order? --24.34.xx.x |

I don't know MA law, but I've been devoting extra time to working things out BEFORE court. Proactive.
I'm tired of giving the judge and the legal process control over my income. If LL is in charge, why do let the court be in charge?
talk to the tenant and work comething out. Sounds like anything is better than what your court will do - assuming there are no more delays/re-scheduling.
