State Specific Question About: MASSACHUSETTS (MA)

While listing my property for rent, I noticed that the fair housing act changed to include "source of income". I always knew that you cannot discriminate against Sect. 8, etc., however I never chose to participate in the Sect. 8 program, so my house is not currently approved. I am wondering, if someone applies and wants to use Section 8 to pay, am I now forced to participate in the program and have them come to approve the property? --24.34.xx.x

Do you use term leases or MTM tenancies? Do your require a 1st, last, SD & a key fee? Do you accept tenants who have ever been evicted? What are you thoughts on not having an applicant answer every question on your application?

I am sure that an experienced LL such as yourself could find numerous reasons to not accept a S8 tenant. --72.85.xxx.xxx

Thank you again Steve! I take it nothing has really changed re; this law then. I never say that I don't take sect8, just that the house is not currently approved under the program. Usually, tenants do not want to wait for the approval process and look for a place which is currently approved. Tammy

Exactly, you are not refusing Section 8. It's just that the property doesn't qualify and you (so far) can't be forced into the program against your will.

Most jurisdictions it is illegal to discriminate on source of income but it is legal to do a thorough credit check on all adult applicants. Most rental housing providers will rent to someone who works as more often then not they go to work during the day then come home to rest not party. A judgement is worthless if the person is on social assistance or disability income. Here as number of smaller rental housing providers are leaving the rental housing business the problem tenants are starting to look to start another eviction. When they ask for apartment right away then there is sheriffs seven day notice on the door. Every adult is required to completely fill out a rental application no exceptions. No identification which is three pieces photo identification or a social insurance number then they take a walk. Often they bring back incomplete rental applications on a Saturday without complete identification or another person wants to move as well without filling a rental application. --74.220.xxx.xxx

Laws vary from state to state, but at least here, before you can rent to Section 8 recipients, you have to undergo an inspection and the property has to be approved.

To become approved for Section 8, you can't charge more than what HUD determines to be FMR or "Fair Market Rental" which is based almost exclusively on the number of bedrooms/baths.

We charge more than the FMR because our rentals are higher end. --64.53.xxx.xx

You can ALWAYS find a way to reject them.

If they ask "Is this apartment Section 8 approved?" Tell them the truth - NO. (It doesn't get approved till it passes inspection).
