State Specific Question About: NEW YORK (NY)

My tenant's lease expired August 31, 2011. He refused to sign a new lease which put him in a month to month tenancy. On September 10, the tenant informs me that he is buying a house and moving out on October 10, and this should be considered his 30 day notice. I informed him that it is a 30 day calendar notice and if he still in the apartment on October 1,2011 or beyond he is responsible for full month's rent of October and his tenancy expires October 31, 2011. Am I correct? --74.73.xxx.xxx

I'm not in New York, but I vote yes. You could be a nice guy and refund the part of rent for October after he is gone, but I doubt it is required. --24.113.xx.xxx

I think he owes till October 31 whether or not he is still there on October 1. I require a 1 month rental period notice. If tenant gives a 30 day notice on September 10 they are responsible for rent till October 31. --98.157.xx.xxx

There is no guarantee they will be out then because the closing may not happen on time. If you have to file for eviction, do so. Let them know it could cost them getting the loan. They may decide to just take their time, too. Maybe even to spite you.

And I think you meant a full 30 day rental period, not 30 calendar days. He gave you 30 calendar days. Given a choice between buying all new furniture for the new house, or paying you, gusess which is priority one. --174.130.xx.xxx

In Florida, a tenant who stays past the term of the lease is considered a "Holdover" tenant subject to a daily rate of one and one half times the regular rate. Is there any such provision in Old NY? --174.48.xx.xxx

You are correct in NY it is a calendar month so if you were given a notice on Sept 10 it is not good till October 31 and he owes for October. --67.252.xx.xx
