State Specific Question About: WISCONSIN (WI)
A tenant that I have has told me he is laid off work right now. I don't really believe that his construction job doesn't have any work for him, and I want to contact his employer to see if he really is laid off. I have a friend who works for the same company but he works on the roofing crew instead of the siding crew. I want to know if it is legal for me to contact him to see if they are busy and have work right now.

I don't know if there are any laws against it. IMO it is unethical. You are going at this situation all wrong. As posted above when he stops paying rent then it's your problem and you deal with it through the legal channels that are already in place. --66.214.x.xxx |

I think it is ok to check. Did you have them sign a release at the end of the application? If so, i think youre good. In construction, being laid off often implies a person will get called back when things pick up again. Bottom line - what does the income and credit look like without the job? Let me tell you a true story.... veteran of LL that I am, about six weeks ago I was coming back from Charlottesville, my uncle was real ill in the hospital. I received a short moving notice from a two year tenant. I hussled (big mistake) to fill it, didn't check his references, & rented to this guy based on "knowing" his aunt as a friend of mine on FaceBook. Knocked off a hundred $$ of the deposit because it was filthy & he agreed to clean it. Well, guess what, couldn't pay the rent this month.... too late, I called his employer, after not getting him (phone canceled), & he said oh yeah, the one that just got out of JAIL!? He doesn't work here for over a month! So, I get all upset, say my husband is on the way to see him.... he says oh don't worry it wasn't a violent offense, just B & E, & Grand larceny.... OMG!
Now this is the same guy that has been "whining" about the sex offender next door..... pot calling kettle black...
We got 300. of rent today... & more promises... do I want him out??? Yes, if he keeps complaining & doesn't pay the rest of the rent... None of them are perfect, & getting worse all the time....
But winter time is coming....

Another contrarian here.
Yes it all boils down to rent paid. But you were just given a HUGE caution flag!! This guy was hinting he will not be paying rent. You have advance notice and can do something about protecting your income. You will soon be calling him for unpaid rent.
Check it out. Don't sit at home HOPING he'll pay (cause he said he would!) or waiting until he falls behind. Time to step into Super Manager mode and nip this in the bud. Either time to go or time to go for help.
Screening rule: tenants lie so verify. My app says "may check references, employment, and credit reports at anytime."
A call to his employer is normal, esp in construction. Employers get calls all the time to verify employment for cars, appliances, etc.
Legally, as a first person creditor, you can contact the employer.
My concern is why did he get laid off when local contractors are hustling to get this closed up before cold weather??? Jail like Pat's guy? Kicked off jobsite for drugs/fighting? Got fired and is lying?
My Landlordy-Sense tells me there is more to the story.
If he is truly laid off, he should be able to show you proof of filing for unemployment and have SOME income in a few weeks.
Our policy: when they ask "can you work with me" that means they are broke. We require an immediate appointment with the 2 local financial aide agencies and we call the agencies to confirm the appt. No appt, no more cooperation from us.
Be a good manager and stay on top of this - Or you'll soon be under it.

not sure why you would consider contacting his employer. is irrelevant and don't know what difference it makes. rent not paid. evict. maybe now in CA you have to be touchy feely and give free rent to anyone who may be unemployed so I'll stand corrected if so.
