State Specific Question About: BIRMINGHAM, ALABAMA (AL)

I had a lease to purchase agreement with tenant, two years lease and then purchase. Tenant paid 5000 as down payment. We filed UD but the Judge dismissed case due to lack of jurisdiction. All agreements expired end of last month but the tenant says he will stay there till I foreclose. He has conveyed through numerous messages that he has no intention of moving our even after the lease and lease to purchase agreement expired end of last month. Attorney's I talk to say there is no way I can move the tenant out before 4-8 months and don't give me any other options. I don't have money to go that long. Tenent sending me harassing messages through different people. What should I do - this is effecting my family, finances and job. Should I foreclose now? --98.195.xxx.xx

Why lack of jurisdiction?Is tenant claiming ownership?Was the court date before or after agreements ended?Start showing up at the property 2-4 times per day,get in there face and tell them to leave,most tenants can't take the pressure and will be gone in a week. --67.252.xx.xx

Once ownership rights are involved the only way is foreclosure, hold a quit-claim deed or obtain a option fee large enough to support 24 months rent plus court/legal costs, one of the rent2own wizards in my area has at least 3 foreclosures in his own name. --68.250.xxx.xxx

lack of jurisdiction is simple in the courts eyes they are not tenants but holders of interest in the property , thus judicial foreclosure hope you have a few grand to pay for a lawyer --216.30.xxx.xxx

The court date was a few days before the agreements expired. They have not claimed ownership probably he doesn't know that he can do that but if he does, he probably will do that as well. The attorney is asking 10K for it. I am still looking for a good attorney though. Seems like all the laws are for tenants no matter what they do. --72.20.xxx.xx
