State Specific Question About: Debt Collection(NJ)

How do I collect monies owed to me by a Tenant that I recently evicted from my property? Do I get a judgement first and then hire an attorney to go after the tenant? I would also like to report the amount owed to all 3 credit reporting agencies. How do I go about doing this? --74.95.xxx.xxx

Does a money judgment not accompany the eviction process in your state? (It does here, but not in all states.) If not then, yes, I'd get a judgment as the first thing. Then, in many areas, just by getting that judgment -- or by "registering" it -- it will make it to their credit reports.

Then, as far as collecting, look into wage garnishment if they have jobs. (And, if they don't have jobs, then consider the fact that you might not be able to collect no matter what you do.)

Personally, I would not hire an attorney for any of this. How much are we talking about?

John,

The amount is $3k approx. I need to stay under this limit to get a judgement through the small claims court. If it is higher then would have to get a judgment in a superior court which takes longer in my state. I believe there is a book on how to collect judgements on Mr Landlord's site. As anyone found it useful? --74.95.xxx.xxx

Is the tenant collectible? Do they have a job? Do you know what/where it is? Do you know where THEY are?

If so, then I'd sue in Small Claims, get the judgment, and then garnish wages.

there is a book you can buy on this site called " small Claims Court How to Collect The Money You Win" , by Jim Martin. It's worth the money. --108.73.xx.xx

Winning the judgment is the first step, credit agencies pick this up automatic, but collecting is like chasing a frog at night, they jump around a lot. --66.72.xxx.xx
