State Specific Question About: NEW YORK (NY)

I have a tennant that pays late and I have had 3 bad checks from this person. Their rent is due on the first and doesn't pay until the 6th or 7th. How can I get this person out. They have lived there 14 months. Please advise. --149.10.xxx.xx

Do they have a current lease? When does the lease term expire? After a year they typically convert to MTM tenants. You could probably just give them 30 days notice, but I don't know the laws in your state. --67.172.xx.xxx

After the first one or two bad checks, I would require future rent payments be paid by money order. Also there would be a late fee.

Send a letter if they are month to month with the new rules - money orders for rent checks with a 25.00 or 50.00 late charge - effective immediately - or give a 30 day notice. your choice. If on a lease - write an addendum.

As long as they pay the rent - so a few days late gives you extra money that adds up.....unless there are other reasons you want them out. --68.229.xx.xx

As soon as I find out a check is bad, I send a letter to the Tenant stating the terms of the lease. The lease basically says that if a check bounces the rent is late. The Tenant is now in violation of the lease. Then Tenant needs to contact me right away with their rent money in order to continue living in the unit. A $5.00 late charge is in effect for each day from the first day of the month until the rent is paid in full along with the late fees. I've never had to evict, but I have collected a good bit of late fees. --64.151.xx.xxx

After the first NSF cheque then one needs to take cash only. One may end up evicting the tenant as arrears may not be cleared. One can contact a landlords association where there are listings on this site to get some help with a eviction if the tenant fails to pay up the arrears. If the tenant wants to pay by cheque then the cheque must be certified where the funds are removed from the account. A certified cheque can not bounce. The tenant may stalling for time where the arrears are only to get worse. --74.220.xxx.xxx
