The tenants gave written not notice they would be moving, but did not give an exact move out. I am giving them a formal 30 day notice. --76.190.xxx.xxx

If they haven't paid the rent, give them a 3-day notice for nonpayment, then file for eviction. Tell them what an eviction on their record does to their future searches for housing. That may make them pay up. --70.143.xx.xxx

What CDM said. There is no such thing as living on their deposit. It's YOUR deposit to cover the possible damages and rent they lease owing.

They are purposely NOT paying you the rent.

DELIVER (tape to the door) the late letter showing late fees and a 3 day deadline before filing for court eviction.

If your area is like many in OH, use a proper 3 day notice, follow with a 24hr notice to inspect damages, if you post Tuesday you can file Friday and may be able to recover at end of month or very close after court hearing and 7 day set-out, review your local laws, I just found a city where the weekends and holidays do count as waiting days - yippeee for me, best to know your local laws from watching in liars court. --76.241.xxx.xx
