State Specific Question About: NEW JERSEY (NJ)

apartment for rent in newspaper, person responded and wanted to move in August 5, 2011, paid $900.00 first months rent on august 1st, 2011.

Tenant did not move in august august 5th because he did not have the security deposit in full.

We agreed that he would move in September 1, 2011, he called on August 30, 2011 and stated when he gets his check tommorow we will meet. He stated he would move in september 1st. On september 1st did not hear from tenant.

Tenant called on September 2nd late night , we agreed he would sign the lease on Saturday and he would pay the balance of the money.

Tenant called and stated he had 1350 of which he was $50.00 short. I stated that I would forgive the $50.00 and were ok. he stated ok, 10minutes later he texted me and stated he did not want the unit.

Then he texted me again and wanted his money back however he stated that I could take out some money if i had to and he would understand.

1. Do I have to return the 1st months rent that he paid.

2. I took the house of the market anticipating that he would move in. now i lost the whole month of september. i will try hard to get a new tenant fast.

Only you will know your bravery level, visit housing court to learn how this would be handled after a review of state and local law, it seems she/he lost his deposit/rent on your unit - is there anything signed that says you are holding? texting is a great way to tell your kids happy birthday but in my area it is denied for the courtroom procedures. --68.250.xxx.x

Without a holding agreement you are up sheep creek without a paddle. I use the holding agreement my lawyer provides. If they don't move in the dwelling they give me half of the SD funds. That always seemed fair to me.

Even with 15 years experience in this business I am surprised at how easy it can be to skirt the holding agreement form. .... well they are moving in next week on the 25th of August....so we will sign on August 25th and they will give me the deposit money and they will pay the rent for sept on the 1st. We do the 08/25 thing and it's the 3rd of september and here I am sweating have they paid september rent yet? They have until the 5th.

WHY o Why do I put myself through this junk?

Do not have anything signed stating I am holding?, just the prepared lease that was to be signed on the 3rd of September.

I have the completed money order dated August 1, 2011 which states for( Rent 32 north maple avenue ).

He offered to pay me half $450.00 and send him back the balance of $450.00. I have not agreed to anything at this point. I believe I am entitled to keep the full $900.00.

never hold a unit until you have all money. I will hold for one months if I have holding fee, but still show and keep numbers of back up . I do not hold for renters based on promises. and I do go to sc for my holding fee and win, PAPER WORK IS THE KEY, handshakes and promises are all tenant slang for 'still looking' and are you a naive landlord.? can I run the show with bs and turkey neck and vague lies? --99.20.xx.xxx

If it were me Donald I would take the $450 and let it go. Not let it happen to me again.

You have to make your own call on this. NJ is a tenant friendly State from what I have read. Your call LL.

You can't keep anything without a signed rental agreement. Not a lease, but a rental agreement when you accept money. Otherwise you will lose in court. Been there and had it happen. --216.139.xxx.xxx
