State Specific Question About: ILLINOIS (IL)

my tenants lease is to oct. 1,2011 I didnt get rent for aug. and gave her 5 day notice. she moved out by aug 28. and gave no keys. can I bring her in on the 5 day notice and sue for aug, sept. cleaning and new locks?

You'll get some IL answers soon, but here's mine...

The biggest problem at this point is a good address for proper service/delivery of court documents. Our court allows a work address.

You can sue for anything. The question is what will the judge grant. My judge taught our assoc - I cannot grant it unless you ask. He basically told us to ask for anything and he'll decide i he will allow it.

I always ask for too much and let him trim. Sometimes he leaves in those extras. He will never ADD to my total.

If they don't show, I win it all by default!

We complain that it took 30 days to clean up and make all the repairs for damage by the resident.

Locks - sure. Let the judge throw it out if he does not like it.

Cleaning - absolutely! Some judges don't think a LL should be paid for his time, so we specify standard charges on our lease. Basic whole house cleaning is $200. Repairs are $35 per hour.

Or you could instantly start up Acme Cleaning and write a bill.

Add it up and deduct the deposit.

Be certain to comply with IL law for providing written notice of how you applied their deposit or you risk losing it all.

She is out. Get it ready. Rent it. Move on.

Could you file eviction? Yes. But during that time you could not rent and you will lose money. Would you ever see a penny of the judgement you got? Probably not. When you gave her the 5 day you gave her the option of moving which she did. Court is probably not going to give you Sept rent. She already owed you Aug. Send a settlement statement with the balance she owes you to her last known address (yours) registered mail. When it comes back to you do not open it. Put it in her file. Then you can sue her in small claims court for what she already owes you. In the meantime get your place rerented. --208.94.xxx.xxx

Why did you wait this long? She didn't pay on August 1st. You should have served the 5-day on the second. You then should've gone to the courthouse on the 8th and filed the eviction.

ANYWAY, you aren't going to get September. The 5-day notice ends the lease if they don't pay. Since the lease has been terminated, they can't be held responsible for any unpaid rent after the termination. Charge her for unpaid August and cleaning. Throw the locks in if you want, but you should have spare locks laying around. Many feel that replacing locks after tenants is a "cost of doing business" and you'll probably end up eating it.

So, the deposit will cover Aug rent and that will leave you with some repairs and cleaning. It's probably not worth suing the tenant (your cost $100-$150 without lawyer) for a few hundred dollars when you consider that they will not be able to pay you back. You'll be throwing good money after bad. --50.129.xx.xx

Take any free time you have and go to courtroom drama 101, this class is the best learning place and you may see some prospective tenants in the crowd - they will be begging at your feet for some shelter because the (old) landlord would not work with them - if I had a brick for everytime I heard this I could drop them in front of me and walk to Japan! --76.241.xxx.xx

I have always been awarded cleaning fees, all my cleaning supplies and hired help for cleaning. I also have been told

by my attorney we can charge for the next month if the house is not rented yet, but

must show proof I have run an ad and keep

a log of all the callers and people I have shown too. Never have any of my charges
