I have been dealing with HOA violation issues with my tenant and if I receive more complaints the HOA is asking me to evict the tenant. of course, he denies the claims.
He just sent me rent for the next four months in advance as he is traveling on business.
Will accepting the advance rent affect my ability to evict if I need to?
I would return any unused portion of rent received.

You don't want to evict an obviously solvent tenant. You want, however, consult a lawyer to find out if the HOA has any leg to stand on when it comes asking that you evict the tenant. That's the cost of business - you chose to buy there - and should have happened long back.
Seriously, in general HOAs are run by useless busybodies, and it's a mystery why anyone would buy anywhere that is covered by an HOA. --128.226.xxx.xxx |
