State Specific Question About: NORTH CAROLINA (NC)

How can I get a tenant out who has been renting from us for 5 months and pays her rent? The problem is:

1.She does not put her garbage out on the street every week; therefore flies surround the trash can; outside toter stays full and trash stays in house.

2. This is a duplex and the man on the other side (long term tenant who has never complained about anybody before) tells me she (or her teenage sons blast the stereo every night until 3:30 or 4:00 AM keeping him awake.

3. She does not take her turn keeping the grass cut and the man next door has to pick up trash in the yard and mow every week.

4. Her duplex was clean and roach free before she moved in; now it is a wreck and roaches are spilling into the unit next to her from her unit.

5. I have inspected her unit and it is worse than NASTY.

6. I gave her a Tenant Warning Notice last week regarding the loud music and nothing has changed. Am in the process of documenting dates that trash did not get picked up because container was not on street, loud music until 4 AM, roach situation, nasty conditions inside the duplex, front storm door repaired two times and is broken again,etc.

My lease agreement does not mention the above. It does say, "If law enforcement is called to the unit for tenant related problem/disturbance, tenant may be asked to vacate." I have asked my tenant to call the police the next time the stereo is blasting in the middle of the morning.

Maybe I need a new lease agreement.

How can I get this family out?

Yep i'd say you need a new rental agreement, what's the use of having one that doesn't protect your interests ??? . You ought to ask LL(AZ) for a copy of her's. From what she's said there is probably nothing not covered by her agreement (LOL)

Is your agreement MTM ? if so give her 30 days notice. Or you might simply have a talk with her . Tell her she's dirty, her surroundings are disgusting , She is lazy , no one living close to her likes her and neither do you. Tell her she's be better off leaving ASAP and she'll be much happier some where else. People don't like being in places where they are looked down on and despised. Blunt and maybe a little cruel ? Yes, but maybe effective. Then get a decent rental agreement and you won't be in that position again. --99.72.xxx.x

It's called laying waste to the property. Total up the damages. Include cost of Combat gel for the roaches. You should be over her security deposit easily.

Your agreement should state the order all monies are paid i.e. first damages, utilites, etc and lastly rent. When her next rent payment is applied to the damages, she will be short. Then you can evict away. Judge woud appreciate move-in and current conditions photos.Youmight hae to give her a state-mandated time period to pay up. It all depends on your lease/rental agreement and state law. --174.130.xx.xxx

Send her official notice to clean or vacate. If no compliance, you can state she has not complied with the lease regarding care of the property. Like Gwen says, my judge calls it "committing waste." --50.129.xxx.xxx

The police need to determine if the noise is too high, you say the dumpster is full so where is the trash supposed to go? You inspected and now you ask to have the place cleaned for a health dept inspection - take photos of the mess to support your pest/bug service claims which you will deduct, anytime the unit looks like this --> you need to get proactive. --76.241.xxx.xxx
