State Specific Question About: GEORGIA (GA)

On 7/30/11, my husband supposed to meet the 3 new tenants to sign the lease, but only 2 show up and signed the lease. when requested about deposit, tenants want to wait after the third person signed the lease. Then the tenants went to make a copy of the lease which has my signature and their 2's. By the time my husband realized that he should not give them a copy, some arguement came up and he said the deal is off; they then said "ok see you in court"

My question is: the third tenant has not sign the lease, and we didn't receive the deposit, is this contract binding? can we rent to other?

The contract is binding as regards the 3 signatories, that is, the two tenants and your husband.

The moral of the story is that your husband should not sign until he is satisfied that the conditions that he needs are satisfied. Those may include that all of the signatories have signed and that the consideration has been fulfilled.

You might need an attorney. But if they paid nothing, the contract may be held invalid. Both parties must receive some "consideration", some value. Your husband has received none. If the contract states that the deposit has been received and he signed that, then he is really messed up. I did not use the "S" word. --66.226.xx.xxx

I can't imagine anyone taking their case - there are no damages (and thus no money to be made). Do they have keys to your apt yet? Do you have any money from them? If not, what can they do?

I would be surprised if you hear from them again.
