State Specific Question About: NORTH CAROLINA (NC)

I have a thirty day written notice from tenants that were supposed to vacate a property on a month to month lease. They should have been out two days ago and there are still belongings in the unit. I don't see any signs of them moving anything out too quickly and I am not sure what to do. Even though I have a written notice that they would be out, do I still have evict them? can they just take their sweet time moving out? I have someones that wanted to see the place this morning, but I had to cancel because there is still a bed and furniture in there along with a lot of other belongings. --75.143.xxx.xxx

the big unknown is whether they still live there or not. if they don't, call them up and tell them if they want you to throw out a couple things they left behind or not because you got somebody moving in there in a few days --144.188.xx.xx

If they were supposed to be out.. Are they paid up on rent. Or does their rental paying period end on July 31st?

I would just talk with them. If they are not paid up on rent them post a 3 day pay or quit. In KS you can charge 1.5 times the daily rate for holdovers. --165.201.xxx.xxx

They are current on rent, but not for the days that they are staying over. Their move out date was the 24th. I guess that they can take five days if they want since that would be the grace period before they would be late on payment if they were staying, and then I could post a pay or quit, even though they gave written notice. Does this sound correct?

I would still have to evict to take possession even with the written notice that has been given? --75.143.xxx.xxx

You have written notice so I would remove and store the stuff and post a notice that you have it and they have 30 days to pick it up, put it in your garage or something.

Hi Jon...

Well as a LL you may want to check NC statute first

In many states they would be a holdover as they have not returned possession or the keys... it may or is still thier home..

You deduct the days used from the s/d

for now post the front door with the notice to enter and send is in the typical means you have both used, and 1st class mail..

be specific

you have held over your tenancy,

have not returned the keys and have belongings in the house

your rental stops per (insert the statute) when keys are returned.

any cleaning or repairs in addition to the days you have used and held the home will be deducted from the SD

I doubt they will answer your calls nor call you back. They might be long gone. This is the time to step up and stay in control of your investment and cash flow.

I have two tactics.

1. Take pictures. If I determine they are mostly out, we start boxing and bagging, keeping it in the house over the next day or two. We post the ABANDONED PROPERTY notice. If they come back, they can take their stuff. If not, we've made progress.

2. Take pictures. If I determine they have not started moving, (sheets on bed, fresh food in fridge). NOBODY leaves a working TV. I post an ABANDONED PROPERTY notice on the door. They either call to cuss me out (they got the idea!) or skip in the night.

Seldom do we have to take these to court.

"This property appears to be abandoned. All remaining items will be disposed in 24 hours. If this is incorrect, call XXX-XXXX immediately and leave a message."
