I have a one-year rental lease with my tenant. The lease expires soon. Can I amend the current one-year lease to a month-to-month lease? Tenant will give 30 or 60 days notice before move-out and Landlord will give 30 or 60 days before raising rent.

Second thought:

What did you put into this MTM agreement about tenant to give 30 or 60 day notice? Tenants' choice, 30 days or 60 days? What happens if tenant leaves earlier?

Same thing for clause about raising rent. Landlords choice of 30 or 60 days? What happens if landlord gives 45 days notice to raise rent? Rent increase not valid?

The devil is in the details. Be careful how you draft the agreement. Among other things, remember that you cannot preempt state law.

Read the lease, it may do that automatically - many do and many courts interpret this also, good time to study your local and state laws to learn if you need 30-45-60 day notice for these changes. --99.160.xx.xx
