I have a tenant who is in jail for domestic violence. His Mother said he could not meet bail and would not be getting out. I have had two people come to get his things. One of them had the Police show up with them. I told them that I would not let them in since they were not on the Lease and to get a notarized statement from the tenant. the Police said that if they say that they live there then they can take things. I said that I would not let them since they are not on the Lease. The Police told them to go to the DA and sue me. I told them to sue me. Then the Police said if I enter that I am illegally trespassing????? What do you do with their things? How do you proceed on this? Police in this town do not like landlords.

I would consider taking a witness to the jail, and recording the jailbird's instruction regarding getting the place cleared of his belongings. Maybe even pay him a few bucks if you can get his signature on a limited POA, naming his relative or you.

Are you saying that two different people came two different times-and one came with the police?
If I were you, I'd do as Bill says,BUT-I'd be sure to get the jailbird to sign that he gives you possession of the property back, as well as who to let in to get his things. Be sure to give him a deadline when everything left behind will be deemed trash.
Personally, it must be my imagination, but I know of several instances when I was SURE I heard water running inside, and I wanted to protect my property from damage~that is an emergency, so I just went in and checked~ --65.189.xxx.xxx |

You are allowed to enter to make sure your property is secure if you know nobody is living there.
And to check if they have moved out.
I would have been happy with a note from the officer saying he is instructing you to let this person in.
Then I would be friendly and do what I had to get them to completely move everything out. Even if I had to pay them $100.00 to do this by a certain time. All this to get possession right away
How much is it going to cost you in time and money to get an eviction and have the stuff moved.
Need to get it rented to a paying tenant.

Did you get paid for July? he will prolly be out in a week or 2, where is the partner in the domestic - her stuff/are they both on the lease? It seems to me you need a utility bill or proof of residence to gain access, a drivers license or is there mail from someone inside that proves they live there? If the officer wants to sign a prommissory note for damages caused by the moving crew on his behalf or that of the city have him do it, the officer does not know how to answer this one. --76.241.xxx.xx |

I told the Officer that if he would sign a note that they could take the stuff, then they could have it. He wouldn't do it. I asked if they had a piece of mail or a utility bill in their name and the answer was no. I told them to go to the jail and get a notarized note that it was to be released to them. No one has called with a note. I put a 3 day quit notice on the door and mailed it certified. If you are arrested for a violent crime then you can give them a 3 day quit notice. another amazing case of everyone knowing what to sue/b%%^ch/tell landlord what they can or cant do. but on our end everthing is CIVIL and we should call and pay a lawyer to look into it.
I know it does not help to be on cops sh list but some times you just gotta stand your ground. I have had to do this and the next time cops were involved they were a lot less pushy. They do respect a person who approaches everthing like a business. stone cold. --99.20.xx.xxx |

You were right not to let anyone in who is not on the lease. How do you know they don't just want to clean him/her out?If they are legit,they would appreciate you not letting one into their place w/out prior approval. I usually take my chances and clean it out. I try to save memorabilia, stuff of value. When they get out they always make threats etc. Seldom do they have the wherewithall to actually go to to courthouse and file against you. I say boot 'em. --151.213.xxx.xxx |
