State Specific Question About: INDIANA (IN)

OK, I have the tenant whose lease is up August 24, 2011. Per the lease they are responsible for water and garbage. Just received a notice from the city that they are three months past due. I understand the ultimately I will have to pay it if they don't, but any suggestions as how to get them to pay......??? --24.14.xx.xxx

Will the final bill exceed the security deposit? If not take it out of the deposit. Also in the future, require that they pay the water bill directly to you. You bill them when the bill comes in and you apply their payments to the water bill first and the rent second. Thus if they fail to pay the water portion of the bill, they end up short on "rent". It is much easier to take someone to court for being short on the rent than for utility bills. --67.249.xxx.xxx

This is a GREAT rule IF they will turn off the water and not keep it on in your name.

It is a CONSTRUCTIVE eviction without effecting you - since the utility is the one turning off the water, etc.

I suspect there will be eviction cases where retaliation is claimed when the owner did not pay the bill or would not assume responsibility when the tenant defaults. --184.2.xx.xxx

The problem is that apparently in the original posters town, water bills are attached to the property. If he follows my suggestion and modifies his lease to say that payments are applied first to fees and arrears then to current rent, he will have an iron clad defense for evicting for unpaid rent. --67.249.xxx.xxx

Do you mean the sewage instead of water?

In Indiana, sewage leins can be attached to the property, hence the property owner. I find it easier to raise the rent to cover sewage and tell the tenat that I pay sewage and they pay the rest of the utilities. --205.188.xxx.xx

I send a final move out letter (this would be a good time to send for end of August move). In the letter detail your expectations for cleaning, trash disposal, etc.

Also tell them that they must provide you with a paid receipt for water before you can refund their security deposit. I require them to contact the city to arrange for a final read as of their move out. But either way I would ask for a paid receipt. If they don't pay deduct from their deposit. If the deposit is not sufficient then take them to court. --98.250.xx.xxx
