State Specific Question About: NEW MEXICO (NM)

I served my renter with a 30 day eviction notice on June 4th this year.Yesterday he came by and removed some of his belongings but left mostly junk.How long should I wait before removing the stuff that he left ? --75.173.xx.xxx

Well 1s the NM statutes should tell you what you should or must do..

So that is your 1st stop

I evicted a lawyer office tenant in one building one time, had deputy give permission to set out 3 rooms of furniture to the curb, which I did for a few minutes, then moved it all to another office building to funish an empty office at a higher rental price.

Once it's put on the curb, it's available for anyone to scavange before the city hauls away... --96.239.xxx.xxx

1. Make every attempt to contact tenant. Document each call ,visit, etc. You gave him 30 days notice, so he might be thinking he has 30 days.

2. Post ABANDONED PROPERTY NOTICE on the door. "This residence appears to be abandoned. Items remaining after 24 will be disposed. If this is incorrect, call XXX_XXXX and leave a message."

3. In 24 hours, start boxing buy DO NOT give it away or set it out. TOO MANY legal issues with that - his lawyer and judge would rake you over the coals. He might come back and get his stuff.

4. Stack up the stuff in the garage whiel you celan and paint.

5. If you locate him, dleiver the stuff to his new place. That way, YOU are off the hook.

(I know the Craigslist and set-out ideas get great press, but that is lawsuit city and could easily land you in jail.) --66.190.xxx.xx
