Tnant vacatied property 4 days after her 30 days notie she gave but 2 days prior to eviction wants daughter todo walk thru....is that legal? Owes money gave no forward address and claims she is suing me. --216.36.xxx.xxx

You do not have to provide a full security deposit at time of walk through. You have 30 to return. Demand an address so that you can mail security deposit (if any) via certified mail with a reciept for delivery. --96.239.xxx.xxx

I don't know anything about MD, but I am sure that it is legal. But probably not required.

On the other hand, it is a good idea, for both parties, to observe and discuss conditions of the premises and come to agreement about any liability.

Now that the tenant has asked for the walkthrough, if you refuse then you are at a disadvantage in court if the tenant says that something wasn't broken when she left and you say that it was, pictures or no pictures. You have lost credibility.

Your message is too confusing. Did you mean tenant gave a 30 day notice and moved out 4 days after the 30 days???? or 4 days after giving you the notice????? Then you add... "but 2 days prior to eviction"??? So was tenant evicted or did tenant give you a 30 day notice? And when exactly she moved out - is it really important?

But your question was " is it legal for the daughter to do a walk thru?"

Sure, why not. But unless you insist on getting a forwarding address in which to send certified mail (return receipt requested) to the tenant giving an accounting of the security deposit, less any damages, she can threaten to sue you all she wants. Tenant has to leave a forwarding address - which should be in your lease as well as required by your State. Until you get a forwarding address, or send a certified letter and she doesn't pick it up, then you just keep the returned sealed mail until she plays by the rules. You do not have to give the security deposit to anyone except the tenant - and for your records you want to send it certified mail to the addressee only.

If the daughter was not on the lease, I would not do it. If they disagree, now she has a witness to agree with her.

Also no telling if the daughter will show up alone or not. Since eviction was mentioned, it is best not to do one. LL's have been killed at times like these. --70.239.x.xxx
