Assuming rent is paid current you will need to give a 30 day notice which means if you give it today or the last day of this month it will be effective September 1,it is effective from first to first not 30 days after you hand it to them but it doesn't start counting days till the first of the next month.If you give it the last day of this month they probably won't pay you on August 1 and then you can proceed with a 3 day for non payment. --67.252.xx.xx

First if the tenant is refusing to sign a lease then give the tenant a rent increase if one is not in a rent controlled jurisdiction or increase the rent by the maximum a rent control guideline will allow. If one wants to evict the tenant then one should contact a landlords association as every jurisdiction has a different set of rules for evictions.
