State Specific Question About: NEW YORK (NY)

What are the first steps to evicting a tenant for refusing to sign a new lease and refusing to move. Should I stop collecting rent, do I need to obtain a lawyer? If not can I getting some guidance on how to proceed.

Assuming rent is paid current you will need to give a 30 day notice which means if you give it today or the last day of this month it will be effective September 1,it is effective from first to first not 30 days after you hand it to them but it doesn't start counting days till the first of the next month.If you give it the last day of this month they probably won't pay you on August 1 and then you can proceed with a 3 day for non payment. --67.252.xx.xx

State laws followed with local court rules, if rent is being paid why do you want the tenant to move, there must be something else not covered in your lease, you could try adding it with an addendum but this must comply with current laws. --76.241.xxx.xxx

First if the tenant is refusing to sign a lease then give the tenant a rent increase if one is not in a rent controlled jurisdiction or increase the rent by the maximum a rent control guideline will allow. If one wants to evict the tenant then one should contact a landlords association as every jurisdiction has a different set of rules for evictions. There are listings of landlords associations on this site so click into associations. It is worthwhile to belong to a landlords association. --74.220.xxx.xxx
